WHEREAS, The Port Authority of Allegheny County, has requested this portion of Summerlea Street to be vacated, in order to facilitate the Negley Station renovation project.
WHEREAS, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of the Department of Mobility and Infrastructure, in accordance with all applicable law and proper procedures, are authorized to vacate to The Port Authority of Allegheny County, a portion of Summerlea Street, situated in the 7th Ward, 8th Council District, in the City of Pittsburgh, more particularly bound and described as follows:
That vacating Summerlea Street, 50 feet in width, beginning at a point being the Southwestern most corner of property of now or formerly Port Authority of Allegheny County, Tax Parcel No. 84-J-1 45. And said point of beginning being on the Northerly side of a 40 foot right-of-way, known as Pierce Street and the Easterly side of a 50 foot right-of-way, known as Summerlea Street; Thence from said point of beginning in and through the existing 50 foot right-of-way, known as Summerlea Street, South 67? 42' 00" West, a distance of 50 feet to a point; Thence along the former Westerly side of the 50 foot right-of-way, known as Summerlea Street and along the Easterly property line of now or formerly Port Authority of Allegheny County, Tax Parcel No. 51-M-304, North 22? 19' 00" West, a distance of 15....
