Resolution authorizing the Mayor and the Director of Finance to enter into a permanent easement with the Pittsburgh Water and Sewer Authority (PWSA) and Peoples Natural Gas Company LLC (Peoples) for the installation, maintenance, repair, operation, and removal of a natural gas pipeline on city-owned properties (Parcel IDs 47-P-271 and 47-P-263).

WHEREAS, the Grantor is the owner in fee simple of that certain parcel of real property located in the 24th Ward of the City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania, being identified as Block and Lot No. 47-P-271 and 47-P-263 (”Property”); and
WHEREAS, the Property is subject to that certain Capital Lease Agreement, dated July 15, 1995, between CITY and PWSA, whereby PWSA has a leasehold interest in the Property, and among other things, conveying an interest in the Property to PEOPLES requires PWSA’s consent to the conveyance; and
WHEREAS, PEOPLES desires a non-exclusive right of way and easement over, upon and through the Property for the purposes of installing, maintaining, repairing, operating, and removing a natural gas line; and
WHEREAS, the City has agreed enter into an easement agreement for the purposes as defined herein.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. Resolution authorizing the Mayor and the Director of Finance to enter into a permanent easement with PWSA and Peoples for the installation, maintenance, repair, operation, and removal of a natural gas pipeline on city-owned properties (Parcel IDs 47-P-271 and 47-P-263).
The Easement and Easement Area are depicted on the drawings that are attached hereto as Exhibit A.
