Resolution vacating Regis Way and a portion of Rapidan Way, both located in the “Ball Park Plan” as recorded in Plan Book Volume 19, Pg. 56, situate in the 12th Ward, 9th Council District of the City of Pittsburgh.

WHEREAS, Steel City Squash, requested this vacation of Regis Way and a portion of Rapidan Way, to accommodate the construction of a new non-profit educational and athletic recreation facility.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1.
All that certain right of way, being a portion of Regis Way, 20.00 feet wide, to be vacated, situate in the 12th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the easterly right of way line of Shetland Street, 40.00 feet wide, and the northerly right of way line of Regis Way, 20.00 feet wide; thence from said point of beginning by the northerly right of way line of Regis Way N 63° 36’ 00” E a distance of 237.95 feet to a point on the westerly right of way line of Joseph Street, 40.00 feet wide; thence by the westerly right of way line of Joseph Street S 26° 24’ 00” E a distance of 5.89 feet to a point; thence continuing by same S 39° 54’ 00” E a distance of 14.51 feet to a point on the southerly right of way line of said Regis Way; thence by the southerly right of way line of said Regis Way S 63° 36’ 00” W a distance of 236.54 feet to a point on the easterly right of way line of said Shetland Street; thence by the easterly right of way line of said Shetland Street N 39° 54’ 00” W a distance of 20.57 feet to a point on the northerly right of way line of said Regis Way, at the point of beginning.
Containing an area of 4735 square feet or 0.109 acres.
Section 2. All that certain right of way, being a portion of Rapidan Way, 20.00 feet wide, to be vacated, situate in the 12th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the southerly right of way line of Regis Way, 20.00 feet wide, and the easterly right of way line of Rapidan Way, 20.00 feet wide; thence from said point of beginning by the easterly right of way line of Rapidan Way S 39° 54’ 00” E a distance of 39.60 feet to a point; thence by a line through Rapidan Way S 50° 06’ 00” W a distance of 20.00 feet to a point on the westerly right of way line of Rapidan Way; thence by the westerly right of way line of Rapidan Way N 39° 54’ 00” W a distance of 44.40 feet to a point on the southerly right of way line of said Regis Way; thence by the southerly right of way line of Regis Way N 63° 36’ 00” E a distance of 20.57 feet to a point at the intersection of the southerly right of way line of said Regis Way and the easterly right of way line of said Rapidan Way, at the point of beginning.
Containing an area of 840 square feet or 0.019 acre.
Section 3. The City of Pittsburgh reserves the Right for a public easement and long the realigned former Regis Way between Shetland and Joseph Streets and small portion of Rapidan Way, which will allow continued full access for the properties along Rapidan Way.
Section 4. PWSA indicates they have a 6" distribution water main located in Regis Way and Rapidan Way. PWSA will require a relocation of this waterline. PWSA has a 15” sewer line located in the proposed street vacation area. The portion of sewer main located in Regis Way will need to be relocated or abandoned.
Section 5. PWSA Reserves the Right for a Utility Easement(s): The street vacation will be void if PWSA water and sewer facilities are not relocated or an easement is not granted for existing infrastructure. No structures will be permitted to be constructed over top of existing PWSA facilities. No fixed permanent structures will be permitted that will impact or compromise daily operation and/or maintenance of PWSA water and sewer infrastructure or facilities located within the easement parameters if an easement is granted. Any hardscape or landscape will be the responsibility of the property owner to replace if damaged during repair or maintenance of PWSA facilities.
Section 6. This resolution, however, shall not take effect or be of any force or validity unless STEEL CITY SQUASH, shall, within sixty (60) days after the effective date of this resolution, remit to the Treasurer, City of Pittsburgh, the sum of four thousand eight hundred fifty dollars and twenty-five cents ($4,850.25).
