Resolution amending Resolution 866 of 2010, authorizing the creation of the Emergency Medical Services Hazardous Materials Trust Fund, to rename the fund, and clarify and update its uses.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. That the City Controller is hereby authorized and directed to create a trust fund entitled "Emergency Medical Services Public Safety Hazardous Materials Trust Fund" into which shall be deposited funds paid to the City from Allegheny County (LEPC) and/or income generated as a result of direct billing of responsible parties as recoverable for hazardous materials responses, for the purpose of purchase of equipment, supplies, medical certifications and examinations for Department of Public Safety hazardous materials personnel, training, and unrecoverable hazardous material cleanup cost.
Section 2. The Trust Fund shall be established within the Department of Public Safety, Bureau of Emergency Medical Services Administration, set forth in the City of Pittsburgh’s annual budget, and may only be expended through the regular contracting process or other expenditures as set forth in the city.
Section 3. Any proceeds received by the City from Allegheny County (LEPC) and/or income generated as a result of direct billing of responsible parties as recoverable for hazardous materials responses, shall be transferred to this Trust Fund.
