Resolution authorizing the Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, to enter into an agreement with the Pittsburgh Water and Sewer Authority for coordination of certain work surrounding the operation and maintenance of Liberty Green Park.

WHEREAS, the City and PWSA were parties to the East Liberty/Larimer Park Cooperation and License Agreement ("Cooperation Agreement") executed on January 9th, 2018; and
WHEREAS, the Cooperation Agreement provided for the transfer and development of an area referenced therein now known as Liberty Green Park; and
WHEREAS, the Cooperation Agreement further provided that with respect to Liberty Green Park, the "Project maintenance responsibilities...excluding below-ground storm water infrastructure that will be maintained by PWSA, shall transfer to City" upon completion, transfer, and dedication of Liberty Green Park; and
WHEREAS, on March 22, 2017, PWSA entered into an agreement with the Allegheny County Sanitary Authority ("ALCOSAN") for receipt of a Green Revitalization of Our Waterways ("GROW") Grant, to fund green infrastructure in Liberty Green Park; and
WHEREAS, on October 5th, 2020, as part of the going development of Liberty Green Park Project, PWSA entered into an agreement with the Urban Redevelopment Authority (Park Agreement); and
WHEREAS, pursuant to the Park Agreement, PWSA agreed to 1. "Act as Manager of the ALCOSAN GROW grant received for this project"; 2. "Complete post-construction monitoring as part of the requirements of ALCOSAN Grow Grant award"; 3. "Coordinate with the City of Pittsburgh to accept a long-term Operations and Maintenance Plan consistent with the requirements of ALCOSAN GROW Grant award that identifies PWSA as responsible for maintenance of "'below ground stormwater infrastructure'"; and
WHEREAS, on May 4th, 2021, an Instrument for the Declaration of Restrictions and Covenants ("IRDC") was recorded against the Liberty Green...
