Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into a License and Maintenance Agreement in which the City grants to Walnut Capital a right to plant and maintain landscape improvements upon City property along Bakery Square Boulevard in Mellon Park.

WHEREAS, the City owns Mellon Park, located in the Shadyside Neighborhood, 7th Ward of the City of Pittsburgh; and
WHEREAS, Walnut Capital is willing to plant and maintain landscape improvements upon City property along Bakery Square Boulevard in Mellon Park to maintain improvements at Mellon Park and the City is willing to have Walnut Capital’s assistance in improving and improving and maintaining a portion of Mellon Park; and
WHEREAS, Walnut Capital seeks access to City-owned property for the purpose of planting and maintaining landscaping along Bakery Square Boulevard in Mellon Park; and
WHEREAS, the City has agreed to grant access to Walnut Capital for the purpose of planting and maintaining landscaping along Bakery Square Boulevard in Mellon Park; and
WHEREAS, the parties now desire to set forth their mutual responsibilities in this regard;
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of the Department of Public Works are hereby authorized to enter into a License and Maintenance agreement with Walnut Capital for the purpose of planting and maintaining landscape improvements upon City property along Bakery Square Boulevard in Mellon Park.
