Resolution authorizing the Mayor and the Director of the Department of Finance to grant a temporary construction easement to 2013 PA Brushton, LLC to perform land stabilizing work.

WHEREAS, 2013 PA Brushton, LLC must perform land stabilizing work, slope regrading, and landscaping (the “Project Work”) in Ward 12 of the City; and
WHEREAS, 2013 PA Brushton, LLC desires a temporary construction easement on City property located at lot and block number 173-P-185 (the “Property”) for the purpose performing said land stabilizing work; and
WHEREAS, the City is willing to grant to 2013 PA Brushton, LLC a non-exclusive temporary right and privilege to enter upon the Property for the purpose of necessary land stabilizing work, slope regrading, and landscaping.
WHEREAS, the parties now wish to execute a Temporary Construction Easement to document party responsibilities associated with the land stabilizing work.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of the Department of Finance, on behalf of the City of Pittsburgh, are hereby authorized to execute a Temporary Construction Easement Agreement granting a temporary construction easement to 2013 PA Brushton, LLC to access lot and block number 173-P-185. Said Temporary Construction Easement Agreement shall be in the form approved by the City Solicitor and shall contain such terms and conditions as the Solicitor may require.
