Title
Resolution authorizing the Mayor and the Director of the Department of Public Works, on behalf of the City, to enter into an Agreement with Columbia Gas of Pennsylvania granting them (1) a temporary Right of Entry for the purpose of installing a regulator station in McKinley Park; and (2) a license to allow regulator station equipment to remain for a period of time in McKinley Park.

Whereas, Columbia Gas operates a regulator station in McKinley Park; and

Whereas, the proposed project increases the safety and integrity of Columbia Gas's operations in and around McKinley Park and there are no feasible alternatives outside McKinley Park for Columbia Gas to locate its facilities that would allow for the continued safe and reliable service of natural gas to McKinley Park and the citizens of Pittsburgh; and

Whereas, Columbia Gas is under a federal mandate to maintain safe and efficient facilities within public ways and places pursuant to Section 1501 of the Public Utility Code; and

Whereas, Columbia Gas seeks temporary access to City-owned property. Known as McKinley Park, to install facilities; and

Whereas, the temporary access sought by Columbia Gas is specifically for the purpose of installing a regulator station; and

Whereas, the City of Pittsburgh, as the owner of McKinley Park and the Trustee of the Park for the benefit of the people of the City, seeks to preserve the safety of its people and the integrity of McKinley Park; and

Whereas, the City is willing to grant a temporary Right of Entry and License to Columbia Gas to allow the regulator station to remain in McKinley Park subject to the terms and conditions set forth in the proposed agreement.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. The Mayor and Director of the Department of Public Works, on behalf of the City, are now authorized to enter into an Agreement with Columbia Gas of Pennsylvania granting them (1) a temporary Right of Entry for the purpo...
