Resolution granting unto MIDPOINT GROUP OF COMPANIES, their successors and assigns, the privilege and license to construct, maintain and use at their own cost and expense, subsurface tieback anchors, a guide rail, twelve (12) bollards, a cheek wall and a tree pit at 1450 Colwell Street, in the 3rd Ward, 6th Council District of the City of Pittsburgh, Pennsylvania.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. That MIDPOINT GROUP OF COMPANIES, their successors and assigns, are hereby granted the privilege to construct, maintain and use at their own cost and expense, subsurface tieback anchors, a guide rail, twelve (12) bollards, a cheek wall, and a tree pit at 1450 Colwell Street, in the 3rd Ward, 6th Council District of the City of Pittsburgh, Pennsylvania.

Subsurface tieback anchors will be installed at the following three (3) locations:

1. Colwell Street - 110 +/- anchors on a currently a 60' row (which will be reduced to 38.5
feet upon pending street vacation), 307" in length
2. Stevenson Street - 50 +/- anchors on a 64' row- 72' in length
3. Our Way - 40 +/- anchors on a 28' row- 282' in length

Tieback anchors, both temporary and permanent, (see Exhibit A) will be utilized for earth retention purposes to support building foundation wall elements and be at least three feet in depth. They are necessary due to grade changes and are needed to safely construct the project. Grantee must contact and remain a member of the PA One Call System, in the 3rd Ward 6th Council District of the City of Pittsburgh.

Twelve (12) bollards:

1. Eight (8) bollards will be installed at the intersection of the Colwell and Pride Streets at the southwest corner radius.
2. Four (4) bollards will be installed along Our Way at the service/loading entrance to the building.

One (1) tree pit will be placed on Stevenson Street.

One (1) guide rail will be installed on Pride Street.
