Resolution authorizing the Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, to enter into an Agreement or Agreements with the South Side Community Council, a 501(c)(3) organization, for the City of Pittsburgh to grant to the South Side Community Council, its successors and assigns, the privilege and license to improve and maintain Esser Plaza, parcel 3-H-00015, located at 1200 East Carson Street, 15203, in the 17th Ward of the City of Pittsburgh, Pennsylvania.

WHEREAS, formerly the Birmingham Plaza, the plaza was renamed Cindy Esser Plaza in August 2006 to honor the long-time South Side advocate who passed away in October 2002; and
WHEREAS, Esser Plaza is now a poorly lit park area between Armstrong Park and the old market house in the heart of Pittsburgh's historic South Side; and
WHEREAS, a planning process led by the South Side Community Council and residents in the South Side community resulted in a plan and funding to revitalize the plaza to be a welcoming, open space where the community can gather; and
WHEREAS, the City is willing to offer the South Side Community Council the privilege and license to improve and maintain Esser Plaza; and
WHEREAS, the City and the South Side Community Council now wish to enter into a License and Maintenance Agreement to define the South Side Community Council responsibilities for developing and maintaining Esser Plaza in accordance with the Drawings/Plans attached hereto as Exhibit A.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. That the Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, are hereby authorized to enter into an Agreement or Agreements with the South Side Community Council, for the City of Pittsburgh to grant to the South Side Community Council, its successors and assigns, the privilege and license to improve and maintain Esser Plaza, parcel 3-H-00015, locate...
