Resolution authorizing the Mayor and the Directors of the Department of Public Works and the Department of Finance, on behalf of the City of Pittsburgh, to enter into an easement agreement or agreements with Duquesne Light Company to provide a permanent easement for the relocation of its electrical system in Hays Woods (Parcels 31-G-200, 31-G-202, and 32-H-100) at no cost to the City.

WHEREAS, the CITY is the owner of that certain parcel of property situated in the 31st Ward of the City of Pittsburgh, Allegheny County, Pennsylvania, Lot & Block 31-G-200 9 (“Property”); and

 

WHEREAS, Duquesne Light owns infrastructure for the transmission or distribution of electricity (the “System”) on the Property; and

 

WHEREAS, the System within the Property is part of a larger network of electricity transmission and distribution that serves residents of the City; and

 

WHEREAS, Duquesne Light has determined that land under and surrounding the System is prone to movement; and

 

WHEAREAS, Duquesne Light requests to relocate its infrastructure to another location within the Property to avoid further adverse impact to Duquesne Light’s System and the surrounding land; and

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Directors of the Department of Public Works and the Department of Finance, on behalf of the City of Pittsburgh, are authorized to enter into an agreement or agreements for the following easements with Duquesne Light Company:

 

1)                     A permanent easement for purposes of installing, operating, maintaining, repairing, and removing its electrical system on the Property; and

2)                     A temporary easement for purposes of installing and utilizing access routes on the Property.

 

The Easement Area is depicted on the drawings that are attached hereto as Exhibit A.
