Resolution submitting regulations for the implementation and enforcement of the Landlord Registration Ordinance (i.e. City of Pittsburgh Code (“City Code”), Ch. 781 (“Residential Housing Rental Permit Program”)), to the Council of the City of Pittsburgh as required by City Code §781.06 and recent Court Order in a related active litigation matter in the Court of Common Pleas of Allegheny County, docketed at GD 15-023074 (“Realtors Association of Metropolitan Pittsburgh et al. v. City of Pittsburgh”).

WHEREAS, the City is involved in an active litigation matter wherein Plaintiffs have challenged the rental housing permit requirements of Chapter 781 of the City Code; and
WHEREAS, Section 781.06 of the City Code requires the Department of Permits, Licenses and Inspections (PLI) to promulgate regulations for the implementation and enforcement of Ch. 781; and
WHEREAS, Section 781.06 of the City Code requires PLI to communicate the regulations to Council 30 days prior to their posting; and
WHEREAS, according to the Initial Case Management Order dated December 14, 2017 (see attached) by Judge Joseph M. James in the active litigation matter referenced above, the City is required to 1): provide notice to Plaintiffs of the public comment and hearing period regarding the Regulations promulgated pursuant to the Landlord Registration Ordinance; 2) conduct said public comment and hearing period; and 3) obtain Council’s “passage” of the regulations; and
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. Resolution submitting regulations (see attached) promulgated by the City’s Department of Permits, Licenses and Inspections (“PLI”) for passage by the Council of the City of Pittsburgh, pursuant to the implementation and enforcement of City Code Chapter 781 (“Residential Housing Rental Permit Program”) as required by §781.06 thereof and court order in the related active litigation matter docketed at GD 15-023074.
This Resolution authorizes the City of Pittsburgh to take all necessary steps to ensure compliance with City Code §781.06 and the Initial Case Management Order dated December 14, 2017 (see attached) issued by Judge Joseph M. James in the active litigation matter docketed at GD 15-023074, which requires the City to 1): provide notice to plaintiffs of the public comment and hearing period; 2) conduct a public comment and hearing period; and 3) obtain Council’s “passage” of the regulations. As further indicated in therein by Judge James, such regulations shall be stayed and shall not be enforced until further notice from the Court.
