Resolution adopting the plan submitted to the electors of the City of Pittsburgh entitled, “Restoring Pittsburgh Parks” and “The Parks Plan” (collectively, “The Parks Plan”) by the Pittsburgh Parks Conservancy prior to the November 5, 2019 Municipal Election as the official parks plan of the City of Pittsburgh and the City of Pittsburgh Parks Trust Fund.

WHEREAS, on Tuesday, August 6, 2019, a petition was submitted to the Allegheny County Board of Elections pursuant to 53 Pa.C.S.A. § 2942 containing in excess of 29,000 signatures requesting a referendum to amend the Pittsburgh Home Rule Charter (the “Charter”) to establish the City of Pittsburgh Parks Trust Fund; and,
WHEREAS, the referendum additionally called for a .50 mill increase in the City’s real estate tax to fund the trust fund; and,
WHEREAS, prior to the 2019 Municipal Election, the proponents of the Trust Fund and Charter Amendment submitted to the electorate a detailed, equitable and transparent plan including capital projects listing what the funds, if approved, would be used for; and,
WHEREAS, the will of the citizens, as expressed by the results of the referendum to amend the Home Rule Charter, was that the Charter should be amended, a Parks Trust Fund established and that one of the ways that Council should provide public funds to the trust fund was through an increase in the real estate tax; and,
WHEREAS, the City of Pittsburgh wishes to accept The Parks Plan as the primary guiding document for the City and the City of Pittsburgh Parks Trust Fund.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Parks Plan, submitted by the Pittsburgh Parks Conservancy, attached to this Resolution as “Exhibit A”, is hereby adopted as the official plan of the City of Pittsburgh Parks Trust Fund.
Section 2. The Mayor shall submit any necessary changes or revisions to The Parks Plan to Council for approval.
Section 3. Any conflicts between this Resolution and the Home Rule Charter Amendment, approved November 5, 2019, shall be resolved in favor of the Charter.
