WHEREAS, to facilitate pedestrian safety within the public right of way LICENSEE proposed installation of a mural or murals (“Artwork” or “Project”) on the surface of the public right of way, as further depicted in Exhibit A (“Site” or “the Site”) to supplement the Department of Mobility and Infrastructure’s traffic calming project on the south side of Woods Run Ave. in a section of roadway in front of the Carnegie Library of Pittsburgh - Woods Run Branch located at 1201 Woods Run Ave; and

 

WHEREAS, LICENSEE desires to improve connection to the Carnegie Library of Pittsburgh - Woods Run Branch and to enhance DOMI’s goals of slowing traffic along Woods Run Ave., a street with a documented history of speeding and crashes. The artwork will be painted in an area that DOMI has already marked to exclude motor vehicle traffic or parking; and

 

WHEREAS, the design for the Artwork was given approval by the City of Pittsburgh Public Art & Civic Design Commission (“PACD”) on April 24, 2024. LICENSEE’s PACD application is attached hereto as Exhibit B, and PACD’s approval is attached hereto as Exhibit C; and

 

WHEREAS, LICENSEE will seek and obtain a permit through the Department of Mobility and Infrastructure (“DOMI”), authorizing LICENSEE to install the Artwork within the Site, and which shall be made part of Exhibit A; and

 

WHEREAS, the Department of City Planning includes a Public History, Art, & Design division (“PHAD”), that administers the implementation of City of Pittsburgh public art projects; and

 

WHEREAS, LICENSEE agrees to maintain the Artwork and Site for as long as the Artwork is permitted to exist; and

 

WHEREAS, City intends to grant LICENSEE a non-exclusive license to maintain the Artwork within the public right of way;

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Director of the Department of Mobility and Infrastructure are authorized to enter into a License and Maintenance Agreement for Limited-Term Public Art with Bike Pittsburgh, Inc., a non-profit corporation, having a mailing address at 188 43rd St., Suite 1, Pittsburgh, PA 15201 (“LICENSEE”), said limited-term public art to be installed on the surface of the public right-of-way, in a section of roadway in front of the Carnegie Library of Pittsburgh Woods Run Branch, located at 1201 Woods Run Avenue.

 

Section 2.                     The agreement and amendments are subject to the approval of the City Solicitor as to form and substance.
