Resolution requesting the approval of an inter-municipal transfer of restaurant liquor license, License No. E-3448, from Subco Enterprises, Inc. - dba Rudy's Subs 1 1229 Long Run Road, White Oak, PA 15131-2038 to Applicant FVAV, Inc. dba - Italian Village Pizza - Waterworks Mall, 979 Freeport Road, Pittsburgh, PA 15238 into the premises to be known as Italian Village Pizza, pursuant to amended Pennsylvania Liquor Code, §4-461.

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:
Section 1. The Council of the City of Pittsburgh hereby endorses the request for approval of an inter-municipal transfer of a restaurant liquor license, License No. E-3448,
Subco Enterprises, Inc. - dba Rudy's Subs 1 1229 Long Run road, White Oak, PA 15131-2038 to Applicant FVAV, Inc. dba - Italian Village Pizza - Waterworks Mall, 979 Freeport Road, Pittsburgh, PA 15238 into the premises to be known as Italian Village Pizza, pursuant to amended Pennsylvania Liquor Code, §4-461.
Section 2. Request for Approval
FVAV, Inc. dba - Italian Village Pizza, which has the mailing address of Waterworks Mall, 979 Freeport Road, Pittsburgh, PA 15238 submitted a request for approval of an inter-municipal transfer of a restaurant liquor license, License No. E-3448, which is currently registered to Subco Enterprises, Inc. - dba Rudy's Subs 1 1229 Long Run road, White Oak, PA 15131-2038 5 desires to place a restaurant liquor license into the premises known as Italian Village Pizza, Waterworks Mall, 979 Freeport Road, Pittsburgh, PA 15238. The proposed interior of the premises is a restaurant business containing 2,852 square feet of floor area.
Section 3. Public Hearing
City Council shall set a date for a Public Hearing for the purpose of receiving comments and recommendations of interested individuals residing in the City of Pittsburgh concerning Italian Village Pizza, Waterworks Mall, 979 Freeport Road, Pittsburgh, PA 15238, intent to the above liquor license.
Section 4. Approval or Denial of Request
After the Public Hearing which was held December 13, 2011, and within 45 days of the introduction of this Resolution, City Council shall render a decision to approve or disapprove the request of Italian Village Pizza, Waterworks Mall, 979 Freeport Road, Pittsburgh, PA 15238, for inter-municipal transfer of a restaurant liquor license. City Council must approve the Italian Village Pizza request unless it finds that approval would adversely affect the welfare, health, peace and morals of the City of Pittsburgh or its residents.
