Resolution vacating a portion of Glenhurst Road between Beechland Street and its terminus in the 31st , Ward, 5th Council District of the City of Pittsburgh.
 
Body
WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Glenhurst Road in the 31st Ward, 5th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
 
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.     That vacating a portion of Glenhurst Road, 40' wide from Beechland Street to its terminus, adjacent to lot and blocks 133-N-288 and 134-M-100 and Lot No. 43 in the Roosevelt Acres No. 2 Plan of Lots, P.B. Volume 41, Page 58:
 
As a result of this 40 feet vacation to the adjacent owner, their new property line would be adjacent to City parcel 134-M-100 which is part of the 31st Ward Greenway.  To avoid any future encroachment into this Greenway the owner s are required to install a fence on the perimeter of this property at their own expense.  The type of fence to be installed would require the approval of the City of Pittsburgh Planning Department, and also reserving the right of easement of any water lines located therein, in the 31st Ward, 5th Council District of the City of Pittsburgh as described above, shall be and the same is herby vacated.
