Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.      The Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, are hereby authorized to enter into a Construction and Maintenance Agreement with CSX Transportation, Inc. ("CSXT"), Urban Redevelopment Authority of Pittsburgh ("URA") and Soffer Organization, Inc. ("Soffer"), in a form approved by the City Solicitor, under which CSXT will partially reconstruct the J & L Tunnel, remove adjacent railroad bridges and construct other improvements at South Side Works on property owned by the City of Pittsburgh, URA and/or Soffer, all at CSXT's sole cost and expense.
