Resolution vacating a portion of Sassafras Way/Alley between 29th and 30th Streets in the 6th Ward, 7th Council District of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Sassafras Way/Alley in the 6th Ward, 7th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
 
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      That vacating a portion of Sassafras Way/Alley is as described:
 
All that certain lot or parcel of land situate in the 6th Ward, City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania, more particularly bounded and described as follows:
 
Situate in the 6th Ward, City of Pittsburgh, Allegheny County, being the same alley in the Springfield Farm Plan of the Denny Estate known as Sassafras Alley recorded in Allegheny Plan Book Volume 6, Page 180.
 
Beginning at the southeast corner of Liberty Avenue and 29th Street, said corner adjusted 5.0' feet by Vacation Ordinance Book Volume 53, Page 367, dated September 22, 1944, thence; South 40° 39' 18" East along and parallel to the original line of lot 1 in the aforementioned plan 174.0' feet to the point of beginning at the adjusted (by vacation) Northeast corner of  Sassafras Alley and 29th Street, thence South 40° 39' 18" East a distance of 24.0'feet to the southerly edge of the 24' foot right of way of Sassafras Alley, thence North 49° 20' 42" East a distance of 245.0' feet along said right of way line to a point on the right of way line opposite the line dividing lots 10 and 11 in said plan, thence North 40° 39' 18" West a distance of 24.0' feet to the southeast corner of lot 10, thence South 49° 20' 42" West along the northerly right of way line of Sassafras Alley a distance of 245.0' feet to the point of beginning;
 
Also reserving the right of easement of an 8" waterline and a 20" sewerline located therein.
 
      1.            The Water Mapping indicates that there is 8" PWSA waterline in 29th Street that services a private water service line. The existing PWSA waterline in 29th Street       must be retained to service existing PWSA and Private infrastructure/facilities, hence current right-of-way must be retained as a PWSA public utility easement.
 
      2.      The Sewer Mapping indicates that there is 20" PWSA sewerline within the area of the proposed vacation.  The existing sewerline in the vacated right-of-way area must be retained to service existing PWSA and Private infrastructure/facilities, hence current right-of-way must be retained as a PWSA public utility easement.
 
PWSA Reserves the Right for a Utility Easement(s)
Be advised no fixed permanent structures (buildings, walls, etc.) will be permitted in the vacated right-of-way area that will impact or compromise daily operation and/or maintenance of existing or proposed new PWSA facilities including construction and/or reconstruction activities. PWSA can accept conventional street/drive-way type paving and/or landscape areas except trees, in the 6th Ward, 7th Council District of the City of Pittsburgh, as described above is hereby vacated.
