Title
Resolution amending Resolution 404 (Bill No. 2006-0497) as previously amended by Resolution 205 (Bill No. 2007-1317) finally locating rights of ways and accepting the dedication of roadways which are part of the North Shore Roadway Improvement Phases I-V/Stadium Projects and North Shore Infrastructure HOV Modifications Project, in the 22nd Ward, 6th Council District of the City of Pittsburgh.

Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      That the location and establishment of rights of way and other roadway improvements located in the rights of way pursuant to Resolution 404 of 2006, as amended by Resolution 205 of 2007, as such rights of way are set out in the Final Drawings for North Shore Right of Way and North Shore Infrastructure, as Built Drawings on file in the Department of Public Works (updating Department of Engineering and Construction Project No. 98407 and Survey Plan 3638) are hereby ratified and confirmed, provided that those certain exceptions and reservations set forth in Resolution 404 are hereby removed, that is,
  • the right of way of Art Rooney Avenue from the Centerline of West General Robinson Street to the Centerline of North Shore Drive, and
    • the right of way of Mazeroski Way from the centerline of West General Robinson Street to
the centerline of Reedsdale Street; and
 
o      provided that such Resolution is further amended to clarify that the dedication made and accepted by Resolution 404 of the Fort Duquesne Pedestrian Ramp and Stairs includes the entire pedestrian right of way as described therein; and
 
o      the location and establishment of rights of way and other roadway improvements as modified by this Section 1 is hereby accepted.
 
Section 2.  That Resolution No. 404 of 2006 is further hereby amended by amending Description 5 thereof by adding the following description describing additional right of way for Reedsdale Street created by the North Shore HOV Modification Project, and the location and establishment of such additional right of way described below is hereby accepted:
Being all of that certain piece or parcel of ground to be dedicated as additional right of way for Reedsdale Street, this parcel is situate in the 22nd Ward of the City of Pittsburgh, Allegheny County, P A, being more particularly bound and described as follows:
Beginning at a point on the western right of way line of Mazeroski Way, of varying width, having a City of Pittsburgh coordinate value of North 105379.38 feet and East 97650.06 feet, thence, by a new line through lands now or formerly of the Stadium Authority of the City of Pittsburgh, Lot and Block number 8-K-5, the following six (6) courses and distances:
  1.   By a curve to the left with a radius of 47.00 feet and an arc length of21.82 feet with a chord bearing North 31009'54" West 21.63 feet to a point. Thence;
  2.   South 87°14'36" West 53.63 feet to a point. Thence;
  3.   North76°01 '26" West 52.54 feet to a point. Thence;
  4.   South 87°35'51"West 151.64 feet to a point. Thence;
  5.   North 84°29'49" West 26.97 feet to a point. Thence;
  6.   North 85°26'53" West 59.24 feet to a point on the southerly right of way of existing Reedsdale Street. Thence, continuing along the existing southerly right of way line of Reedsdale Street, the following two (2) courses and distances:
  7.   By a non tangent curve bearing to the left with a radius of 992.53 feet and an arc length of 186.29 feet with a chord bearing North 82° 36'32" East 186.01 feet to a point. Thence;
  8.   North 87°30'05" East 132.74 feet to a point on the western right of way of Mazeroski Way.  Thence, continuing along the western right of way of Mazeroski Way;
  9. By a non tangent curve bearing to the right with a radius of 78.00 feet and an arc length of 59.02 feet with a chord bearing South 35°08'40 "East 57.62 feet to a point. Thence;
  10. South 13°28'09" East 12.50 feet to the point and place of beginning.
 
The above described parcel of ground contains 7,734.69 square feet or 0.178 acres of land and is more clearly shown on Exhibit "A", a plan prepare by LR Kimball entitled "Right of Way Survey" dated August 02, 2010 and revised through August 11, 2010.  Project 10-1300-0169.
Section 3.  That the grading, curbing, traffic signals and other roadway improvements located in the rights of way, in conjunction with the existing rights of way all as set out in the Final Drawings for North Shore Right of Way and North Shore Infrastructure including the addition of the portions of right of way previously excepted by Resolution 404 (referenced in Section 1 hereof) and the modification describing additional right of way for Reedsdale Street which is described above and on the attached Exhibit, As built Drawings each on file in the Department of Public Works (updating Department of Engineering and Construction Project No. 98407 Plans and Survey Plan 3638, on file in the Department of Public Works) are hereby accepted and declared to be public improvements of the City of Pittsburgh and opened as public highways of the City of Pittsburgh.
Section 4.  That any Resolution or Ordinance or part thereof conflicting with the provisions of this resolution is hereby repealed so far as the same affects this Resolution.
