Title
Resolution providing for the City of Pittsburgh to receive grant funding based on the filing of applications with the U.S. Department of Labor and/or Commonwealth of Pennsylvania for grants in connection with the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Employment Advancement and Retention Network (EARN), cost not to exceed $8,027,991.00.
 
Body
Providing authorization for the City of Pittsburgh to enter into agreements authorized by the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Employment Advancement and Retention Network (EARN), as amended (cost not to exceed $8,027,991);
 
Providing for required assurances; execution of payment vouchers and of certification of authorized signatures; providing for contracts with various agencies/employers for services and programs related to training and employment for Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Employment Advancement and Retention Network (EARN) and providing for the deposit of funds into a bank account.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      The Mayor and the City of Pittsburgh are hereby authorized to receive grants based                                     on the filing of  applications in the form required by the U.S. Department of Labor and/or Commonwealth of Pennsylvania in connection with the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Employment Advancement and Retention Network (EARN); in order for grants to be made in connection with the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Employment Advancement and Retention Network (EARN).
 
Section 2.      In the event that the U.S. Department of Labor and/or the Commonwealth
should approve said applications through a grant to the City of Pittsburgh for contracts in connection therewith, the Mayor and the City of Pittsburgh, on behalf of the City, is hereby authorized to execute said contracts.  Said contracts shall be in a form approved by the City Solicitor and shall contain such terms and conditions as said Solicitor may require.
 
Section 3.      The City of Pittsburgh, as a recipient of grant funds, will assume full responsibility for all funds which may be provided under WIA and EARN.  The City of Pittsburgh assures that said funds will be used in an economical and efficient manner in carrying out the WIA and EARN.
 
Section 4.      The City of Pittsburgh hereby assures its full compliance with the implementation
of the following:
    1. Regulation of the United States Department of Labor effectuating Title VI of the Civil Rights Act of 1964 and any amendments thereto;
    1. Applicable laws relating to equal employment opportunity;
    1. Federal labor standards imposed under Title VII of the Housing Act of 1961, as amended, where applicable;
    1. Age Discrimination Act of 1975;
    1. Section 504 of the Rehabilitation Act of 1973;
    1. Title IX of the Educational Amendments of 1972 on the basis of sex;
    1. Americans with Disabilities Act;
    1. Other certifications and/or assurances not related to expenditures as may be required by the Grantor and approved by the City Solicitor.
 
Section 5.      Any two of the following four officers are hereby authorized to execute payment
vouchers on grant contracts with the Commonwealth of Pennsylvania in connection with said project or projects:
      
Mayor
 
Controller
 
Director of the Department of Finance
 
Director of the Department of Personnel and Civil Service Commission
 
Section 6.      The City Clerk is hereby authorized and directed to certify the authenticity
of the signature of the officers designated in the preceding section, in connection with the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Employment Advancement and Retention Network (EARN).
 
Section 7.      The City Treasurer is hereby authorized and directed to deposit the funds referred
in this Resolution into a bank account.
 
Section 8.      The Mayor and the Director of the Department of Personnel and Civil Service
Commission, on behalf of the City of Pittsburgh, are hereby authorized to enter into agreements with
non-profit organizations, private-for-profit businesses, and various agencies to provide services including, but not limited to coordination, recruitment, outreach, assessment, support services, pre-vocational and/or vocational training, job search assistance, job counseling, remedial education, basic skills training, institutional skills training, on-the-job training, school-to-work transition activities, welfare-to-work, literacy training, work experience, vocational exploration, job development, pre-apprenticeship programs, disseminating information on program activities, CareerLink Centers support, follow-up services, program evaluations, and financial and personal counseling, for qualified adult dislocated workers and youth and effectuation of grievance procedures and to provide payment for the costs thereof in order to support, implement, and administer the Workforce Investment Act of 1998 (WIA) and/or the Joint Jobs Initiative Program Employment Advancement and Retention Network (EARN).
              Said agreement or agreements shall be in a form approved by the City Solicitor and shall contain such terms and conditions as said Solicitor may require.  The total amount payable under said agreement or agreements shall not exceed Eight Million Twenty-Seven Thousand Nine Hundred Ninety-One ($8,027,991) Dollars, chargeable to and payable from the JTPA/WIA Trust Fund, Fund 2300, Account 566000, Organization 109600, Sub-Class 600, Budget Year 2011.  The total amount consists of Workforce Investment Act of 1998 (WIA) funding in the amount of Four Million Four Hundred Forty-Two Thousand Two Hundred Five ($4,442,205) Dollars, and Joint Jobs Initiative Program Employment Advancement and Retention Network (EARN) funding in the amount of Three Million Five Hundred Eighty-Five Thousand Seven Hundred Eighty-Six ($3,585,786).
