Title
Resolution vacating a portion of Bradley Street and Horner Street and vacating all of Eustace Way, Floree Way, Ruthledge Street, Unnamed Way and Vaughn Street in the 19th Ward, 2nd Council District of the City of Pittsburgh.
 
Body
WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of vacating a portion of Bradley Street and Horner Street and vacating all of Eustace Way, Floree Way, Ruthledge Street, Unnamed Way and Vaughn Street in the 19th Ward, 2nd Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
 
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
WHEREAS, the above three (3) Ways and four (4) Streets all lie within the Duquesne Heights Greenway, being part of the Grandview Scenic Byway Park and the adjoining property owner adjacent to all seven (7) is the City of Pittsburgh.
WHEREAS, these seven (7) rights-of-way are considered "paper" rights-of-way and serve no functional use, the Parks and Recreation Department is petitioning City Council to vacate these rights-of-way so the land area can revert to become part of the Duquesne Heights Greenway property.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      The descriptions of the property to be vacated are as follows:
      Vacating part of Bradley Street, 35 feet wide, from the Southeast corner of parcel 6-B-47 at its intersection with Bradley Street Northward to its terminus.  Having an Easterly line of 614.98 feet and a Westerly line of 575.98 feet for an average distance of 595.48 feet containing 20,842 square feet of area.
      Vacating part of Horner Street, 40 feet wide, from the Easterly line of parce1 6-A-339 at its intersection with Horner Street Eastward to its terminus.  Having a Northerly line of 791.68 feet and a Southerly line of 751.71 for an average distance of 771.7 feet containing 30,868 square feet of area.
      Vacating all of Eustace Way, 20 feet wide, from its intersection with an Unnamed Way Eastwardly to its terminus at its intersection with Bradley Street.  Having a Northern line of 1,212.12 feet and a Southerly line of 1,191.76 feet for an average distance of 1,201.94 feet containing 24,039 square feet of area.
 
 
      Vacating all of Floree Way, 30 feet wide, from its Southerly terminus to its Northerly terminus. Having a Westerly line of 972.06 feet, an Easterly line of 963.6 feet and an Easterly, 10 feet wide extension of 93 feet, for an average distance of 1,060.83 feet containing 29,965 square feet of area.
 
Vacating all of Ruthledge Street, 40 feet wide, from its Southern intersection with Greenleaf Street to its Northern terminus at the previously vacated portion (Resolution 144 of 2001), at the projected dividing line of parcels 6-E-150 and 6-E-175.  Having a Northerly line of 757.85 feet and a Southern line of 779.94 feet for an average distance of 768.9 feet containing 30,756 square feet of area.
 
      Vacating all of an Unnamed Way, 20 feet wide, from its Northerly intersection with Greenleaf Street to its Southerly intersection with Rutledge Street. Having an Easterly line of 201.32 feet and a Westerly line of 195.01 feet for an average distance of 198.17 feet containing 3,963 square feet of area.
      Vacating all of Vaughn Street, 40 feet wide, from its intersection with Rutledge Street to its Eastern terminus at the previously vacated portion (Resolution 144 of 2001), at the projected line ofparceI6-E-150 and 6-E-175.  Having a Northerly line of 325.25 feet and a Southerly line of 455.55 feet for an average distance of 390.4 feet containing 15,616 square feet of area.
 
The total area to be vacated and added to the Duquesne Heights Greenway area is 156,049 square feet or 3.58 acres, in the 19th Ward, 2nd Council District of the City of Pittsburgh as described above is hereby vacated.
