Title
Resolution authorizing the Mayor and the Director of the Department of Public Works and the Director of the Department of Parks and Recreation to enter into a Project, Maintenance, and License Agreement with the Children's Museum of Pittsburgh to provide capital improvements/renovations and specified subsequent maintenance to Allegheny Public Square.
Body
WHEREAS, the City owns the public park now known as Allegheny Public Square (the "Park"), which is located in the 22nd Ward; and
WHEREAS, the Park is slated for expansion via a conveyance by the Urban Redevelopment Authority to the City; and
WHEREAS, the Children's Museum of Pittsburgh "(CMP") has offered to perform a renovation/capital improvement project for the newly expanded Park; and
WHEREAS, the City wishes to accept this offer for the benefit of the public; and
WHEREAS, the CMP and the City now wish to enter into a Project, Maintenance, and License Agreement to define the scope of the project and subsequent specified maintenance to be provided by the CMP at the Park.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. Intending to be legally bound, for and in consideration of the mutual premises hereinafter set forth, the parties hereto agree as follows:
The Mayor and the Director of the Department of Public Works and the Director of the Department of Parks and Recreation are hereby authorized to enter into a Project, Maintenance, and License Agreement with the CMP, pursuant to which the CMP will make renovations/capital improvements to Allegheny Public Square. The term of the Project, Maintenance, and License Agreement shall be for twenty-one (21) years (Calendar Year 2032). The Project, Maintenance, and License Agreement shall be approved by the City Solicitor as to form and substance.
