Title
Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into a License and Maintenance Agreement with Garfield Heights, LLC ("GHLLC") to maintain a planting median strip on Fern Circle stretching from the intersection of Fern Circle and Fern Street to the south and Fern Circle and Schenley Avenue to the north.
 
Body
WHEREAS, the Garfield Heights, LLC ("GHLLC"), a non-profit Pennsylvania corporation, has offered to maintain a planting median strip to be owned by the City and located on City property stretching from the intersection of Fern Circle and Fern Street to the south and Fern Circle and Schenley Avenue to the north.
 
 
WHEREAS, the City now seeks to enter into a License and Maintenance Agreement with the Garfield Heights, LLC ("GHLLC")  to set forth terms relating to the construction and maintenance of the planting median strip.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  The Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, are hereby authorized to enter into a License and Maintenance Agreement with the Garfield Heights, LLC ("GHLLC"), to maintain a planting median strip from the intersection of Fern Circle and Fern Street to the south and Fern Circle and Schenley Avenue to the north.  The License and Maintenance Agreement shall permit a revocable term of ten (10) years and shall be approved by the City Solicitor as to form and substance.
