Resolution vacating of a 20 foot Unnamed Way, from Marion Street to its terminus in the 1st Ward, 6th Council District of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of this a 20' Unnamed Way from Marion Street eastwardly to its terminus in the 1st Ward, 6th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. Vacating a 20 foot unnamed way from Marion Street eastwardly to its terminus, as depicted on the Plan of Subdivision for the Estate of Marian Pride Dec'd, as recorded in Plan Book Volume 1, Page 36, situate in the 1st Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the easterly right of way line of Marion Street, 50.06 feet wide, and the southerly right of way line of an alley, 20.02 feet wide, said point being N 03° 22' 35" E a distance of 133.70 feet from a point at the intersection of the northerly right of way line of Boulevard of the Allies, State Route No. 0885, variable width, and the easterly right of way line of Marion Street; thence from said point of beginning by the easterly right of way line of Marion Street N 03° 22' 35" E a distance of 20.02 feet to a point on the northerly right of way line of said alley; thence by the northerly right of way line of said alley S 86° 37' 00" E a distance of 103.81 feet to a point on the easterly terminus of said alley; thence by the easterly terminus of said alley S 03° 22' 35" W a distance of 20.02 feet to a point on the southerly right of way line of said alley; thence by the southerly right of way line of said alley N 86° 37' 00" W a distance of 103.81 feet to a point at the intersection of the easterly right of way line of said Marion Street and the southerly right of way line of said alley, at the point of beginning , in the 1st Ward, 6th Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
Section 2. This resolution, however, shall not take effect or be of any force or validity unless owners of all the property fronting or abutting on Unnamed 20 foot Way as vacated by this resolution, shall, within (60) sixty days after the effective date of this resolution, pay into the Treasury of the City of Pittsburgh the sum of $4,700.00 use of the City of Pittsburgh.
