Body
WHEREAS, the Council of the City of Pittsburgh has adopted a Resolution authorizing and directing the Mayor of the City to enter into a sales agreement with the Pittsburgh Parking Authority ("Authority") for the sale of Mellon Square Garage, five street lots and all of the street meters known collectively as the City Parking Facilities ; and
 
WHEREAS, the City of Pittsburgh (the "City") owns certain parking assets known as Mellon Square Garage, the five street lots, and the Parking Meter Network, which are known collectively as the City Parking Facilities; and,
 
WHEREAS, pursuant to the Pennsylvania Motor Vehicle Code, 75 Pa.C.S. §6109(h)(1), Section 4404(d)(21) of the Parking Authority Law, 53 Pa. C.S. §5505(d)(21) and various agreements between the City and the Pittsburgh Parking Authority ("Authority"), the Authority manages the City Parking Facilities, including the enforcement and administration of the ordinances and regulations adopted by the City with respect thereto; and,
 
WHEREAS, the City of Pittsburgh must comply with Pennsylvania Act 44 of 2009 to create a revenue stream that will provide a minimum of 50% funding of the Comprehensive Municipal Trust Fund of Pittsburgh by January 1, 2011, or in the alternative, the City's pension fund would be taken over by Pennsylvania Municipal Retirement System (PMRS);
 
 
WHEREAS, Pennsylvania Employee Retirement Commission (PERC) has made a determination that it would accept a present value of irrevocably pledged future revenue streams derived from parking fees levied on public garages and meters in order to attain, at a minimum, 50% funded pension fund;
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      The Pittsburgh Code, Title Five - Traffic, Article VII - Parking, Chapter 543 - Parking Meters, Section 543.01 - Parking Meter Zones and Rates, is hereby amended and restated, as follows:
 
§ 543.01  PARKING METER ZONES AND RATES.
 
(a)      The following on-street surface parking meter zones are hereby established, and the boundaries of each such zone shall be as set forth in the maps contained in Exhibit Appendix 1 to this Ordinance:
·      Downtown
·      Oakland - Zone 1
·      Oakland - Zone 2
·      Oakland - Zone 3
·      Oakland - Zone 4
·      Shadyside
·      Strip District
·      North Shore
·      South Side
·      Squirrel Hill
·      North Side
·      Uptown
·      Brookline
·      Mount Washington
·      Bloomfield / Garfield
·      East Liberty
·      Lawrenceville
·      Mellon Park Area
·      Beechview
·      Allentown
·      West End
·      Carrick
 
 
(b)      Parking meter zones shall have the following rates and hours of operation:
 
The following hourly on-street metered parking fees are enforceable Monday through Saturday per the schedule below.  Enforcement will begin at 8 a.m. in all zones and will conclude at either 6 p.m. or 10 p.m., as specified.  The initial rates in each zone are shown in the column captioned "Current".  The first rate adjustment will take effect on June 1, 2011 March 31, 2011 following the close of the transaction, while all subsequent rate adjustments will occur on January 1 of the respective year. No meter rate adjustments for a particular meter zone may go into effect until all the meters in that particular zone have been modernized according to terms of the sales agreement.

Note: Current rate for Oakland Zone 4 is calculated as an average rate based on 260 spaces at $.50/hour and 176 spaces in Schenley Plaza at $1.00/hour for the first 4 hours and $2.00/hour for each additional hour thereafter.
 
(c)      The City of Pittsburgh shall supply approximately 922 additional meter spaces.
(d)      Assuming an average rate of inflation, no rate increases will be required by this transaction until 2017. For the life of any debt associated with this transaction, the board of the Authority will increase rates so as to comply with all bond covenants.  If no rate adjustment ordinance is so adopted, then the rates for the immediately preceding period shall remain in effect.  The rates set above in Section (b) shall remain in effect until December 31, 2015.
