Title
Ordinance amending the Pittsburgh City Code, Title IV, Public Places and Property, Article I: Public Rights of Way, Chapter 416: Obstructions by temporarily amending the current regulations during the NHL Winter Classic Activity Period.
 
Body
WHEREAS, the City of Pittsburgh has been selected to host the NHL Winter Classic (the "Event"); and  
 
WHEREAS, this large-scale civic Event will attract many visitors to the Pittsburgh region and will provide an outlet for the City to showcase its many unique assets to both these guests and to television viewers on a national and international scale; and
 
WHEREAS, this Event also provides opportunities for the City to enhance future business development and tourism; and
 
WHEREAS, City Council now wishes to temporarily amend existing Banner regulations to facilitate public awareness of the Event.  
 
Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:
 
Section 1.      Chapter 416 of the Pittsburgh City Code is hereby amended by adding Sections 416.01(f)-(h) to temporarily amend banner regulations as follows:
 
§  416.01(f)  
 
For the purposes of this temporary Ordinance, the following words and phrases shall have the meanings ascribed to them in this Section:
 
NHL Winter Classic Activity Period:  Unless otherwise stated herein, the definitions, procedures, regulations and enforcement provisions of this Ordinance shall generally apply to activities authorized hereunder for a limited duration period beginning at 12:01 a.m. on Monday, December 13, 2010, and ending at 12:01 a.m. Monday , January 3, 2011.
 
§  416.01(g)      Street and Sidewalk Banners
 
A.      To support public awareness of this important international sporting event, the City will temporarily permit street and sidewalk banners as defined in this Chapter 416 of the City Code to be hung in designated locations for the duration of the NHL Winter Classic  Activity Period promoting a sports theme of Hockey, the NHL Winter Classic Activities, and/or the NHL and further subject to the following condition:  
 
a.      The limited duration permit for sidewalk announcement pole banners shall be issued by the City's Department of Public Works.  
 
b.      The limited duration permit issued for street and sidewalk pole banners shall be approved by the Department of Public Works.  Specific placement of pole and street locations shall be designated on the limited duration banner permit and shall not exceed Three Hundred Fifty (350) banners. A list of such locations shall be available at the Department of Public Works, located at 611 2nd Avenue, Pittsburgh, PA  15219.  
 
c.      Limited duration permit holders shall be required to hang and remove all banners.  Banners not removed by January 15, 2011, may be subject to removal by the City.  All costs associated with clean-up and removal shall be assessed to the limited duration banner permit holder.  
 
d.      The sidewalk banners shall conform in size and construction requirements with temporary sidewalk banner regulations promulgated by the Department of Public Works for the Official NHL Winter Classic Activity Period. The banners may include announcement of the NHL Winter Classic Celebration Activities or information otherwise relating to a sports theme of Hockey and/or the NHL and may also include other information related to the Event, including but not limited to advertising or sponsorship of the NHL Winter Classic Hockey Game or related activities to the extent that such advertising comprises no more than 33% of the banner  face.   
 
e.      The permit fee for each banner permitted above shall be Ten Dollars ($10.00) per banner.  The permit holder may agree to leave banner-hanging hardware valued at approximately Fifty Dollars ($50) per set for the permanent use of the City, in which case the value of such hardware shall be deducted from the permit fee.
 
§  416.01(h)      Sunset Provision
 
The amendments to this Chapter 416 set forth herein shall be revoked in their entirety and all of its provisions shall cease to apply as of 12:01 a.m. on Monday, January 3, 2011.
