Resolution granting to Columbia Gas Company a permanent pipeline easement and a temporary construction easement through designated City of Pittsburgh property in the 27th Ward.  
 
Body
Be it resolved by the Council of the City of Pittsburgh as follows:
 
 
Section 1.  The Mayor and the Directors of the Department of Finance and Public Works, on behalf of the City of Pittsburgh, are hereby authorized to execute an agreement granting to Columbia Gas Company a permanent easement and a temporary construction easement, upon which to lay pipelines together with service connections, over and through the premises hereinafter described, and to operate and maintain without restriction or limitation, repair, replace or change the size of its pipes without interruption to service, and remove same, together with valves and other necessary appurtenances on lands situated in the City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania, and more particularly described in Deed Book 6516 Page 36 as derived by deed recorded in the office of Recorder of Deeds, Allegheny County, Pennsylvania.  Said agreement shall be in the form approved by the City Solicitor and shall contain such terms and conditions for the protection of the City of Pittsburgh as the Solicitor may require. The easements granted to Columbia Gas Company hereunder are further described on the legal description attached hereto as Exhibit "A-1".
 
Section 2.
 
The privileges and easements hereby granted shall be subject to the following terms and conditions as shall be more specifically set forth in the agreement authorized by this Resolution:
 
a)      Columbia Gas Company shall bear the full cost and expense of the installation, construction, use and maintenance of said easements.
b)      Columbia Gas Company shall indemnify, save harmless, and defend the City of Pittsburgh from any and all damages or claims for damages, whether to property or to person, arising by reason of the construction, installation, maintenance, use or removal of the pipelines.
c)      Columbia Gas Company shall restore the easement areas in cooperation with and in accordance with the requirements of the approved plans for this area and to the satisfaction of the Director of the Department of Public Works.  
d)      Columbia Gas Company shall pay the City the sum of Eight Hundred Dollars ($800.00), due on the date of the signing of the agreement authorized by this Resolution.
 
 
 
EXHIBIT A-1:  LEGAL DESCRIPTION
 
All that certain parcel or piece of ground situate in the 27th Ward of the City of  Pittsburgh, County of Allegheny and Commonwealth of Pennsylvania, being a 20' wide gas pipeline easement, over a portion of lot 2 in the Northgate Plan of Lots, recorded in Plan Book Volume 121, Pages 167-171, and being more thoroughly described as follows:
 
Beginning at a point on the northwesterly terminus of Laird Street, 40' wide, and being at the dividing line between lot 2 in the Northgate Plan of Lots, recorded in Plan Book Volume 121, Pages 167-171, and lands now or formerly of L. McMahon; thence along the northerly terminus of Laird Street, and continuing along the line of lands now or formerly of P. Sullivan, North 87° 51' 08" East, a distance of 303.28 feet to a point on the line of lands now of formerly of S. Shaw; thence along said line, North 3° 13' 52" West, a distance of 18.00 feet to a point at the corner of lands now or formerly of J. Stauffer; thence along the line of Stauffer, and continuing along the lands, now or formerly of J. Pancurak, North 2° 26' 08" East, a distance of 97.92 feet to a point; thence continuing along the line of Pancurak, and also along lands now or formerly of N. Giallonardo, North 0° 25' 50" East, a distance of 304.52 feet to a point at the southwesterly terminus of Birkhoff Street, 40' wide; thence along the westerly terminus of Birkhoff Street, North 15° 59' 17" East, a distance of 20.00 feet to a point; thence through lot 2 in the Northgate Plan of Lots, aforementioned, the following six courses and distances: (first) North 74° 00' 43" West, a distance of 20.00 feet to a point; (second) South 15° 59' 17" West, a distance of 22.73' to a point; (third) South 0° 25' 50" West, a distance of 306.90 feet to a point; (fourth) South 2° 26' 08" West, a distance of 97.16 feet to a point; (fifth) South 87° 51' 08" West, a distance of 283.45 feet to a point; (sixth) South 3° 19' 52" East, a distance of 20.00 feet to a point on the northwesterly terminus of Laird Street, and being the place of beginning of this description.
