WHEREAS, on even date herewith, the Council of the City of Pittsburgh has adopted a Resolution authorizing and directing the City to enter into the Pittsburgh Metered Parking System Concession and Services Agreement (the "Metered System Concession Agreement") with LAZ  Parking and J. P. Morgan IFF Acquisitions LLC, operating as Pittsburgh Parking Partners, LLC   ("Concessionaire"); and
 
WHEREAS, the Council has determined and it is hereby declared as a matter of legislative finding that, in connection with the Metered System Concession Agreement, it is in the best interest of the City to amend and restate the provisions of the Pittsburgh Code regarding the establishment of parking meter zones and rates.
 
 
The Council of the City of Pittsburgh hereby enacts as follows:
 
Section 1.      The Pittsburgh Code, Title Five - Traffic, Article VII - Parking, Chapter 543 - Parking Meters, Section 543.01 - Parking Meter Zones and Rates, is hereby amended and restated, as follows:
 
§ 543.01  PARKING METER ZONES AND RATES.
 
(a)      The following on-street surface parking meter zones are hereby established, and the boundaries of each such zone shall be as set forth in the maps contained in Appendix 1 to this Ordinance:
 
·      Downtown
·      Oakland - Zone 1
·      Oakland - Zone 2
·      Oakland - Zone 3
·      Oakland - Zone 4
·      Shadyside
·      Strip District
·      North Shore
·      South Side
·      Squirrel Hill
·      North Side
·      Uptown
·      Brookline
·      Mount Washington
·      Bloomfield / Garfield
·      East Liberty
·      Lawrenceville
·      Mellon Park Area
·      Beechview
·      Allentown
·      West End
·      Carrick

(b)      Parking meter zones shall have the following rates and hours of operation:
 
The following hourly on-street metered parking fees are enforceable Monday through Saturday per the schedule below.  Enforcement will begin at 8 a.m. in all zones and will conclude at either 6 p.m. or 10 p.m., as specified.  The initial rates in each zone are shown in the column captioned "Transaction Closing Date".  The first rate adjustment will take effect on March 31, 2011 following the close of the transaction, while all subsequent rate adjustments will occur on January 1 of the respective year.
 
 
Note:
1.      Rate at transaction closing date for Oakland Zone 4 reflects an average rate based on 260 spaces at $0.50 / hour and 176 spaces in Schenley Plaza at $1.00 / hr for the first 4 hours and $2.00 / hr for each additional hour thereafter.
 
 
Commencing on January 1, 2016, any changes in the rates for such parking meter zones shall be set by an ordinance duly adopted by the City, in accordance with the terms of the Metered System Concession Agreement to the extent still in effect.  If no such ordinance is so adopted, then the rates for the immediately preceding period shall remain in effect.  
 
(d)      Subject to the Metered System Concession Agreement to the extent then in effect, the City, by a duly adopted ordinance, may from time to time create additional parking meter zones and cause metered spaces to be designated therein.  Rates for any such additional metered spaces shall be set by an ordinance duly adopted by the City, subject to the terms of the Metered System Concession Agreement to the extent still in effect.
