Title
Resolution authorizing the Mayor and the Directors of the Department of Parks and Recreation and the Department of Public Works to enter into a Lease Agreement with the Pittsburgh Ballet Theater for a portion of real property located on Liberty Avenue between 29th and 30th Streets.

Whereas, in 1995, the City entered into a fifteen (15) year Lease Agreement with the Pittsburgh Ballet Theater ("PBT") for the area commonly referred to as Denny Park; and
 
Whereas, under the terms of said Lease Agreement, the PBT agreed to renovate and maintain the park in exchange for the ability to use parking spaces along with park patrons; and  
 
Whereas, the parties now wish to enter into a new Lease Agreement for the same purposes.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  The Mayor and the Directors of the Department of Parks and Recreation and Public Works are authorized to enter into a Lease Agreement with the Pittsburgh Ballet Theater for a portion of real property located on Liberty Avenue between 29th and 30th Streets in the Sixth Ward, Pittsburgh, Allegheny County, Pennsylvania, known as Denny Park.
 
Section 2.  The Lease Agreement shall be for a term no longer than fifteen (15) years and in consideration therefore, the Pittsburgh Ballet Theater shall maintain the entire grounds known as Denny Park, other than a defined area containing a play structure, which shall be licensed back to the City of Pittsburgh.
