Resolution authorizing the Director of the Department of Finance and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh, to execute Instruments for the Declaration of Restrictions and Covenants in favor of the Allegheny County Sanitary Authority to allow the Pittsburgh Water and Sewer Authority operation and maintenance responsibilities of green infrastructure within certain property along the Bus Rapid Transit Project Corridor.

WHEREAS, the Allegheny County Sanitary Authority ("ALCOSAN") is providing funds in the form of "Grow Grants" to the Pittsburgh Water and Sewer Authority ("PWSA") and City of Pittsburgh to implement green infrastructure improvements operated and managed by the PWSA (the "Grow Grant Projects") upon parcels of land owned or controlled by the City of Pittsburgh; and
WHEREAS, the applicable grant agreement requires that ALCOSAN has access to the Grow Grant Projects during the construction and operation of the Project through a temporary Instrument for the Declaration of Restrictions and Covenants; and
WHEREAS, the City of Pittsburgh and PWSA wish to implement a Grow Grant Project into the Bus Rapid Transit project; and
WHEREAS, the parties now wish to memorialize the terms and conditions relating to the Instruments for the Declaration of Restrictions and Covenants necessary to implement this Grow Grant Project locating within the Bus Rapid Transit Project site area.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1.
