Resolution vacating a portion of Unnamed Way, and a portion of Saline Street in the 14th and 15th Ward, 5th Council District of the City of Pittsburgh.

 

Body

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of the majority of property fronting or abutting on the line of this Unnamed Way, and a portion of Saline Street in the 14th and 15th Ward, 5th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and

 

WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  That vacating a portion of an Unnamed Way between Maromas Street and its terminus:

All that certain strip of ground situate in the 14th Ward of the City of Pittsburgh, County of Allegheny and Commonwealth of Pennsylvania, being that portion of an unnamed Alley lying south of the southerly line of Maromas Street as laid out by the Boulevard Plan of Lots as recorded in Plan Book Volume 20, Page 132. Being more particularly described as follows:

 

Beginning at a point where the easterly line of an unnamed Alley of varied width, intersects the southerly line of Maromas Street, formerly Milroy Street, 40 feet wide, as laid out by the Boulevard Plan of Lots as recorded in Plan Book Volume 20, Page 132 and as shown on the Revision No. 3 to Summerset at Frick Park as recorded in Plan Book Volume 236, Pages 135 through 144; thence from said point of beginning, along Parcel No. 2, Revision No. 1 in said Revision No. 3 to Summerset at Frick Park, the following thirteen courses and distances:

 

1.                     South 46° 58' 04" East, 75.24 feet;

2.                     South 14° 55' 45" East, 60.03 feet;

3.                     South 84° 09' 53" East, 82.03 feet;

4.                     South 44° 11' 11" East, 123.60 feet;

5.                     South 69° 21' 09" East, 158.77 feet;

6.                     South 51° 10' 28" West, 11.61 feet;

7.                     North 69° 21' 09" West, 162.99 feet;

8.                     North 34° 44' 54" West, 24.44 feet;

9.                     North 44° 35' 02" West, 90.92 feet;

10.                     North 84° 09' 53" West, 90.52 feet;

11.                     North 18° 51' 51 " West, 56.10 feet;

12.                     North 50° 40' 49" West, 49.50 feet;

13.                     North 21 ° 55' 50" West, 34.69 feet,

 

to a point where the westerly line of said unnamed Alley intersects the southerly line of Maromas Street projected; thence along said projection, North 83° 10' 23" East a distance of 12.05 feet, to a point on the easterly line of said unnamed Alley, said point being at the place of beginning of this description.

 

Containing 6,269 square feet or 0.144 acre.

 

And vacating a portion of Saline Street, 50' wide:

 

All that certain parcel of ground situate in the 14th Ward of the City of Pittsburgh, County of Allegheny and Commonwealth of Pennsylvania, being the easterly portion of Saline Street and being more particularly described as follows:

Beginning at a point on the easterly line of Tax Map Parcel 88-R-00176 and continuing along the alignment of Saline Street, variable width, in a northeasterly direction through Parcel 14 Revision No. 1 as shown on subdivision plan of Summerset at Frick Park - Revision 19 recorded in Plan Book 254, Page 148 to the point of previous vacation with Ordinance #201 dated July 5, 1918:

1)                     Unnamed Way- Existing 24” PWSA sewer line.  A new sewer easement must be dedicated for the existing PWSA sewers via a new approved sub-division plan.

2)                     Saline Street- Existing 6” PWSA waterline and 8” PSWA sewer line that must be retained.  A new water and sewer easement must be dedicated for the existing PWSA water and sewer lines via a new approved sub-division plan in the 14th and 15th Ward, 5th Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
