Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:
Section 1. The Council of the City of Pittsburgh hereby endorses the request for approval of an inter-municipal transfer of a restaurant liquor license, License No. E-3448, from SUBCO Enterprises, Inc. (formerly trading as Rudy's Subs) 1229 Long Run Road, White Oak, PA 15131, to Applicant The Original Station Street Hot Dog Shop, Inc., 6290 Broad Street, Pittsburgh, PA 15206, c/o Robert F. and Ruth Ann Tortorete, 6731 Adelphia St., Pittsburgh, PA 15206, for the premises located at 6290 Broad Street, Pittsburgh, PA 15206 pursuant to amended Pennsylvania Liquor Code, §4-461.
Section 2. Request for Approval
The Original Station Street Hot Dog Shop, Inc., which has the mailing address of 6290 Broad Street, Pittsburgh, PA 15206, c/o Robert F. and Ruth Ann Tortorete, 6731 Adelphia St., Pittsburgh, PA 15206, submitted a request for approval of an inter-municipal transfer of a restaurant liquor license, License No. E-3448, which is currently registered to SUBCO Enterprises, Inc. (formerly trading as Rudy's Subs) 1229 Long Run Road, White Oak, PA 15131, desires to place a restaurant liquor license into the premises known as The Original Station Street Hot Dog Shop, 6290 Broad Street, Pittsburgh, PA 15206. The proposed interior of the premises is a restaurant business, seating capacity approximately 30.
Section 3. Public Hearing
City Council shall set a date for Public Hearing for the purpose of receiving comments and recommendations of interested individuals residing in the City of Pittsburgh concerning The Original Station Street Hot Dog Shop, Inc. intent to the above liquor license.
Section 4. Approval or Denial of Request
After the Public Hearing which was held April 12, 2010, and within 45 days of the introduction of this Resolution, City Council shall render a decision to approve or disapprove the request of The Original Station Street Hot Dog Shop, Inc., for inter-municipal transfer of a restaurant liquor license. City Council must approve The Original Station Street Hot Dog Shop, Inc. request unless it finds that approval would adversely affect the welfare, health, peace and morals of the City of Pittsburgh or its residents.
