Resolution authorizing the Mayor and the Director of Finance to enter into a Lease Agreement with Eastside Limited Partnership V 133 Penn Circle West, LLC to permit temporary use of the City facility located at 133 Penn Circle West (former Zone 5 Police Station) as a parole office.
 
Body
WHEREAS, Eastside Limited Partnership V 133 Penn Circle West, LLC is currently undertaking a project in East Liberty, known as the Eastside V- Target Redevelopment; and
 
WHEREAS, the Commonwealth of Pennsylvania, Pennsylvania Board of Probation Parole Office (the "Commonwealth") is now located at the proposed redevelopment site; and
 
WHEREAS, the City's former Zone 5 Police Station (the "Premises") is currently vacant due to the recent move of the Zone 5 Police Station to its new Washington Boulevard location; and
 
WHEREAS, the Commonwealth has agreed to temporarily relocate its probation and parole office to the Premises while it searches for a future permanent location; and
 
WHEREAS, in order to accommodate the Commonwealth's move, ESV 133 Penn Circle West, LLC has agreed to update and retrofit the Premises according to Commonwealth specifications; and
 
WHEREAS, the City will also benefit from these capital improvements to the Premises; and
 
WHEREAS, the parties have agreed to lease the Premises (together with the right to use the surrounding parking lot) to ESV 133 Penn Circle West, LLC, which will then sublease it to the Commonwealth for temporary operation of its probation and parole office.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  The Mayor and the Director of Finance, on behalf of the City of Pittsburgh, are hereby authorized to enter into a Lease Agreement with ESV 133 Penn Circle West, LLC for the use of 133 Penn Circle West (former Zone 5 Police Station) and the right to use the surrounding parking lot.  The term of the Lease shall be for one (1) year with two (2) additional one (1) year options according to the following schedule:
 
                  Year 1:  $1.00 per year, plus utilities
                  Year 2:  $1.00 per year, plus utilities
                  Year 3:  $26,400 per year ($2,200 per month) plus utilities
 
      The lease shall be approved in form and substance by the City Solicitor.
