Title
Resolution authorizing the City of Pittsburgh to grant the Pennsylvania American Water Company a permanent utility easement and the privilege and license to install, use, operate, maintain, repair, renew and finally remove a water line easement across City of Pittsburgh property designated as Block 134-A, Lot No. 148 located near Hillburn Street in the 31st Ward.

Body
WHEREAS, The City of Pittsburgh owns certain property near Hillburn Street, Block 134-A, Lot No. 148 in the 31st Ward being an undeveloped portion of this lot; and

WHEREAS, The Pennsylvania American Water Company desires to create a new waterline for the transmission and distribution of water through this undeveloped portion of Block 134-A, Lot No. 148.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. The Mayor and the Director of the Department of Finance, on behalf of the City of Pittsburgh are hereby authorized to execute an agreement with the Pennsylvania American Water Company for a permanent easement through City of Pittsburgh property Block 134-A, Lot No. 148 near Hillburn Street in the 31st Ward. Said agreement shall be in form approved by the City Solicitor and shall contain such terms and conditions for the protection of the City of Pittsburgh as said Solicitor may require.

Description of Utility Easement:
Refer to Exhibit “A” for metes and bounds description of that portion of Block 134-A, Lot o. 148 that will contain the waterline easement of 747 square feet of area. Refer to Exhibit “B” for map or plan that locates the Exhibit “A” description near Hillburn Street in the 31st Ward.

Section 2. The privilege and easement hereby granted shall be subject to the following terms and conditions:
a) The Pennsylvania American Water Company shall bear the full cost and expense of the installation, construction, use and maintenance of said permanent utility easement.
