Body
Whereas the Pittsburgh City Council wishes to attach negative consequences to the undesired behavior of public urination and defecation; and

Whereas the Pittsburgh City Code makes no provision for empowering City Police Officers to cite on a municipal level, using local ordinances, instead of relying on state charges of disorderly conduct and open lewdness; and

Whereas the benefit of a municipal ordinance is the addition of an effective enforcement tool for use by the Pittsburgh Police;

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:

Section 1. The Pittsburgh Code of Ordinances, Title 6: Conduct; Article I: Regulated Rights and Actions; Chapter 601: Public Order is hereby supplemented as follows:


§ 601.16 PUBLIC URINATION AND DEFECATION

(a) Definitions:

"Appropriate sanitary facility" means a urinal, toilet, commode or other facility that accommodates or is designed for the sanitary disposal of human bodily fluids or waste and that is enclosed from public view.

"Public place" means any walkway, street, highway, sidewalk, building façade, bridge, overpass, alley or alleyway, plaza, park, driveway, transportation facility, park, recreational area, parking lot, vacant or undeveloped lot or the stairwells, alcoves, doorways and entrance ways to such places.


(b) Prohibited Conduct

(1) Any person who urinates or defecates in, on, or about any of the following places, other than in an appropriate sanitary facility, commits a violation:
a) Any public place
b) Any private property into or upon which the public is admitted by easement or license; or
