Title
Ordinance authorizing the Mayor and the Director of the Department of Public Safety to enter into Intergovernmental Cooperation Agreements between the City of Pittsburgh and outside agencies to provide professional police and other public safety services for the G20 Summit.   
 
Body
WHEREAS, the City is the host city for the G20 Summit (hereinafter "G20 Event"), a forum for the discussion of international finance issues, to be held September 24-25, 2009, at the David Lawrence Convention Center and other venues throughout the City; and
 
WHEREAS, the Pittsburgh Bureau of Police is responsible for coordinating the overall public safety planning and operations for the G20 Event at the local law enforcement level; and
 
WHEREAS, the City is in need of procuring the assistance of additional police officers and other public safety services to provide all of the public safety and security measures required of the G20 Event; and
 
WHEREAS, the City has identified outside agencies that wish to provide such services pursuant to necessary written cooperation agreements; and
 
WHEREAS, the Intergovernmental Cooperation Act, 53 Pa.C.S.A. § 2301 et seq. authorizes intergovernmental cooperation between a local government and other governmental entities located within or outside the Commonwealth of Pennsylvania in the exercise of their respective governmental functions, powers, or responsibilities; and
 
WHEREAS, the Pennsylvania Emergency Management Services Code, 35 Pa.C.S.A. § 7101 et seq., provides, inter alia, for the provision of mutual aid between local government entities in times where emergency responses are required; and
 
WHEREAS, the Municipal Police Jurisdiction Act, 42 Pa.C.S.A. § 8951 et seq. governs the jurisdiction of police officers within the Commonwealth of Pennsylvania; and
 
WHEREAS, the City now desires to enter into Intergovernmental Cooperation Agreements to establish procedures and protocols for the provision of Agency police and other public safety services for the G20 Summit.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      The Mayor and the Director of the Department of Public Safety are hereby authorized to enter into an Intergovernmental Cooperation Agreement ("IGA") or Agreements with each Agency identified on Exhibit A hereto pursuant to applicable statutory authority. Amendments to the list of agencies provided in Exhibit A shall be permitted in connection with the G20 Event to ensure outside police officer and other public safety needs are met.  The IGA is substantially in the form attached hereto as Exhibit B, with such changes permitted as the City Solicitor deems necessary or desirable to protect the interests of the City and/or are required based on applicable state law. The cumulative total compensation to be awarded to all such Agencies on Exhibit A shall not exceed Nine Million, Four Hundred Ninety Three Thousand, One Hundred Ninety Two Dollars ($9,493,192.00) and shall be payable from and chargeable to:  Fund 5100, Organization 210000, Subclass PGHPR, Project/Grant #GXX2009, Budget Year 2009 in the Department of Public Safety.  Such amount is a portion of the entire Sixteen Million Dollars ($16,000,000.00) appropriated for the G20 Event pursuant to companion legislative Bills  ____.
