Title
Resolution declaring that certain City property near Chartier's Creek shall be dedicated for public park purposes.
 
Body
WHEREAS, by quit-claim deed (the "Deed") dated August 24, 1995, CSX Transportation Inc, conveyed to the City title to 4.10 ± acres of land (the "parcel") located in the 20th Ward of the City of Pittsburgh near Chartier's Creek; and
 
WHEREAS, the parcel is further described in EXHIBIT A, which is attached hereto; and
 
WHEREAS, the Deed specifies that the City may use the parcel for "park, recreational, or open space purposes only"; and
 
WHEREAS, the City now desires to officially dedicate the parcel for public park purposes; and
 
WHEREAS, the Deed further specifies that prior to any use, the City must undertake to construct and maintain certain fences, barricades, and other gates along certain boundaries of the parcel; and
 
WHEREAS, prior to the actual commencement of park use on the parcel, the City intends to comply with the requirements of the deed and install all required fences, barricades, and gates.  
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      It is hereby declared that the above-described parcel shall hereafter officially be dedicated for park purposes.  Actual commencement of park use shall begin after the City complies with all requirements set forth in the deed transferring the parcel to the City.
