Body
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      
 
Whereas, the Friends of the Riverfront has offered to perform monitoring and limited maintenance on the City of Pittsburgh's riverfront trail system and has developed a program of outreach and volunteer activity to provide that service.  
 
Whereas, the City of Pittsburgh wishes to enter into a license agreement with the Friends of the Riverfront in compliance with all applicable local, state, or federal rules and regulations governing such activities inclusive of trail surfaces, landscaping, amenities, litter, signs, and community bike program.  
      
Whereas, the City owns and has primary maintenance responsibilities on the riverfront trails within the City of Pittsburgh.
 
Whereas, such maintenance and upkeep shall be at the sole cost of the Friends of the Riverfront and/or other volunteer groups under its direction.  Any proposed changes in maintenance must be pre-approved in writing by the Director of the Department of Public Works.
 
 
Section 2.      The Mayor and the Director of the Department of Public Works on behalf of the City of Pittsburgh, are hereby authorized to enter into this license agreement with Friends of the Riverfront in a form approved by the  City Solicitor and shall contain such terms and conditions as said Solicitor may require.
      
Section 3.      Any Resolution or Ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed as far as the same affects this Resolution.
