Title
Resolution providing for the settlement of the lawsuit filed by Thomas Flaherty, Controller of the City of Pittsburgh, against the City of Pittsburgh and Pittsburgh City Council at GD 05-0660 as it relates to the budget appropriation of the Controller's Office for fiscal year 2005.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor is hereby authorized to accept the settlement as outlined in the consent order which includes, but is not limited to the following language:
1. 2005 Expenditures. The Office of Controller is precluded from expending any funds during 2005 in excess of $2,564,606.00. The Act 47 Coordinator, the ICA and the City agree that the Act 47 Plan and the 2005 Plan shall be amended to reflect and adjust for this appropriation. The City agrees to undertake the necessary and appropriate action to amend the 2005 Budget for the City of Pittsburgh accordingly.
2. 2006 Appropriation. The expenditures of the Office of the Controller during 2006 shall not exceed $2,300,000.00. The Defendants and Intervener Defendants agree to cooperate in the development of necessary adjustments to the Act 47 Plan and the Proposed 2006 Plan. The Act 47 Coordinator will propose and pursue amendment of the Act 47 Plan to designate expenditures by the Office of the Controller during 2006 at this amount. The City will amend the Proposed 2006 Plan to designate that sum for the Office of Controller for 2006 and adjust that plan accordingly. Upon its review of the Proposed 2006 Plan, the ICA will accept appropriation of that amount for the Office of Controller. The City shall adopt a budget that appropriates that amount to the Office of Controller.
