Resolution amending Resolution No. 446 of 2004, with an effective date of September 21, 2004, which reads, “Terminating the Neighborhood Improvement District in the western neighborhoods of Pittsburgh known as the West End Home Assurance Value ("WE HAV") program” by changing the refund amount from $17.75 to $20.00.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. That Resolution No. 446 of 2004, with an effective date of September 21, 2004, which reads, “Terminating the Neighborhood Improvement District in the western neighborhoods of Pittsburgh known as the West End Home Assurance Value ("WE HAV") program” shall be amended as follows:

Section 1. City Council finds that the attached "Petition from the residents of the City of Pittsburgh requesting a Public Hearing relative to termination of the WE HAV program, pursuant to Pennsylvania Statutes Title 73, Section 838 of 2001, subsection (B) Request for Termination" contains the approval for termination of the NID by more that 40% of the assessed property owners, in numbers located in the NID.

Section 2. City Council hereby terminates the WE HAV NID established by Resolution No. 478 of 2002.

Section 3. Since the West Pittsburgh Partnership existed prior to creation of the NID, and the WE HAV Board of Commissioners (appointed by City Council and the Mayor) administered the NID, City Council's action in terminating the NID is not intended to have any effect on the continuing existence of the West Pittsburgh Partnership.

Section 4. This Resolution shall be filed with the Secretary of the Commonwealth.

Section 5. Upon receipt of the approval of this Resolution from the Secretary of the Commonwealth, the property of the WE HAV Board of Commissioners, approximately $74,311.76, shall promptly be has been delivered to the City of Pittsburgh.
