Resolution requesting the approval of an inter-municipal transfer of a restaurant liquor license, License No. R-07064, from Johnny K's Foods Inc. 9^th & Ohio Streets, Glassport, PA 15045 and/or 115 Old Suffolk Drive, Monroeville, PA 15146 to Circuit Center & Ballroom c/o Lee Deiseroth, 144 North Drive, Pittsburgh, PA 15238 for the premises, located at #5 Hot Metal Street, Pittsburgh, PA 15203, pursuant to amended Pennsylvania Liquor Code, §4-461.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.  The Council of the City of Pittsburgh hereby endorses the request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-07064, from Johnny K's Foods Inc. 9^th & Ohio Streets, Glassport, PA 15045 and/or 115 Old Suffolk Drive, Monroeville, PA 15146 to Circuit Center & Ballroom c/o Lee Deiseroth, 144 North Drive, Pittsburgh, PA 15238 for the premises, located at #5 Hot Metal Street, Pittsburgh, PA 15203, pursuant to amended Pennsylvania Liquor Code, §4-461.

SECTION 2.  Request for Approval

Lee Deiseroth, which has a mailing address of 144 North Drive, Pittsburgh, PA 15238, submitted a request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-07064, which is currently registered to Johnny K's, 9^th & Ohio Street, Glassport, PA 15046 and/or 115 Old Suffolk Drive, Monroe, PA 15146, desires to place a restaurant liquor license into a premises known and numbered as #5 Hot Metal Street, Pittsburgh, PA 15203. The proposed interior of the premises is four, three, and one story connecting office structure with training center and meeting facilities with 37 parking stalls including two handicapped stalls.

SECTION 3.  Public Hearing

      City Council shall set a date for Public Hearing for the purpose of receiving comments and recommendations of interested individuals residing in the City of Pittsburgh concerning Circuit Center & Ballroom c/o Lee Deiseroth, 's intent to the above liquor license.

SECTION 4.  Approval or Denial of Request

      After the Public Hearing which was held Thursday, October 6, 2005, and within 45 days of the introduction of this Resolution, City Council shall render a decision to approve or disapprove of Circuit Center & Ballroom c/o Lee Deiseroth, 's  request for inter-municipal transfer of a restaurant liquor license.  City Council must approve Circuit Center & Ballroom c/o Lee Deiseroth request unless it finds that approval would adversely affect the welfare, health, peace and morals of the City of Pittsburgh or its residents.
