Title
Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into as Agreement with Eastside Limited Partnership II ("Eastside") and the Urban Redevelopment Authority of Pittsburgh ("URA") and acceptance from the URA in connection with the construction of a new pedestrian bridge in the 7th Ward, 8th Council District.

WHEREAS, Eastside is to build a new shopping Center along Center Avenue in East Liberty ; and
 
 
WHEREAS, the URA is to build a pedestrian bridge connecting Ellsworth Avenue with the new shopping center and pedestrian access ways leading from the bride to Highland Avenue and Center Avenue across the shopping center parking deck; and
 
 
WHEREAS, upon the completion of the Project, the URA is to convey the pedestrian bridge and its use, maintenance and repair responsibilities to the City; and
 
 
 
WHEREAS, Eastside is to provide public access to the pedestrian access way improvements; and
 
 
 
WHEREAS, Eastside agrees to maintain and repair the pedestrian access ways.
 
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
 
 
 
Section 1.  The Mayor and the Director of the Department of Public Works are hereby authorized to enter into as Agreement, to be approved in form and substance by the City Solicitor, with Eastside and the URA concerning maintenance and public access to said Pedestrian Access Ways and the acceptance of a Deed of Conveyance from the URA, conveying said Pedestrian Bridge and its use, maintenance and repair responsibilities to the City.
