Whereas, pursuant to Ordinance 212 of 1971 the City vacated the portion of Union Avenue adjacent to the Allegheny Commons Apartments located at 225 E Ohio Blvd in the 22nd Ward of the City of Pittsburgh; and

Whereas, pursuant to Ordinance 362 of 1972, the City granted a license to developers of the Allegheny Commons Apartments allowing for the use of the City's portion of the vacated Union Avenue as an access driveway for the residents; and

Whereas, the owners of the Allegheny Commons Apartments have operated and maintained the driveway and ancillary greenspace on the former Union Avenue since 1972; and

Whereas, the City now wishes to convey all of its interest in the specified portion of the former Union to Allegheny Commons Community Partnership so as to clarify maintenance and security responsibilities.

Be it resolved that the Council of the City of Pittsburgh does hereby enact as follows:

Section 1. The Mayor and the Director of the Department of Finance of the City of Pittsburgh are authorized to execute a quit claim deed or deeds, and any other necessary or appropriate documents, agreements, and instruments conveying to Allegheny Commons Community Partnership LP for consideration of $1.00 AS IS all of the City's right, title and interest, if any, in the portion of the vacated Union Avenue depicted in the attached EXHIBIT A and described as follows:
