Title

Resolution vacating a portion of Turtle Way between Concord Street and Vista Street and a portion of Turtle Way between Vista Street and Klopfer Way and an Unnamed Way in the 23rd Ward, 1st Council District of the City of Pittsburgh.

 

Body

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  Whereas, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Turtle Way and an Unnamed Way in the 23rd Ward, 1st Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of same, and

 

Whereas, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore

 

That Turtle Way, 20' feet wide between Concord Street and Vista Street, a distance of 180'; Turtle Way, 20' feet wide, between Vista Street and Klopfer Way a distance of 230.41'+ feet; and an Unnamed Way, 10' feet wide from Turtle Way eastwardly 140' feet to its dead end and also reserving the right of easement of a 90" sewer line and a 6" water line located therein, in the 23rd Ward, 1st Council District of the City of Pittsburgh as described below shall be and the same is hereby vacated.
