Resolution providing for the creation of the Public Art Fund and setting conditions for the deposit and expenditure of such funds.

WHEREAS the City adopted Section 915.07.D.9 on July 31, 2018; and

 

WHEREAS Section 915.07.D.9 provides an option to developers to increase building height or proximity to a river by making a one-time contribution to the City’s Public Art Fund for use by the City for art on publicly owned lands within the same neighborhood as the development.

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The City Controller is hereby authorized and directed to create a trust fund entitled “Public Art Fund” into which shall be deposited funds paid to the City by 1) developers utilizing Section 915.07.D.9 in lieu of constructing on-site public art, 2) private charitable donations, 3) matching funds from charitable entities, and 4) transfers from the general fund, as budgeted.

 

Section 2.                     Funds deposited into said fund by developers utilizing Section 915.07.D.9 in lieu of constructing on-site public art shall be spent by the City for art on publicly owned lands within the same neighborhood as the development project.

 

Section 3.                     Funds deposited for reasons other than those referenced in Section 2 shall be used on projects relating to the City’s public art program. Appropriate expenditures shall include installations, temporary or performance art, conservation and ongoing maintenance, and insurance premiums.

 

Section 4.                     The Fund shall be administered by the Department of City Planning.
