Resolution authorizing the Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, to enter into an Agreement or Agreements with the Board of Public Education of the School District of Pittsburgh, for the Board of Public Education of the School District of Pittsburgh to grant to the City of Pittsburgh, its successors and assigns, the privilege and license to construct, maintain and use at the City’s own cost and expense, a ball playing field, to be located on the grounds of Pittsburgh Faison K - 5 School, parcel 0175-B-00320, at 7430 Tioga Street, in the 13th Ward of the City of Pittsburgh, Pennsylvania.

WHEREAS, a planning process led by Homewood Community Sports and residents in the Homewood community resulted in a Master Plan for the Homewood Park; and
WHEREAS, it was determined that the high usage of the Homewood Park field for football demanded a separate field for softball, baseball, and potentially flag football; and
WHEREAS, PPS is willing to offer the use of the field at Pittsburgh Faison K - 5 School for this purpose, with the City maintaining the field and related amenities; and
WHEREAS, PPS and the City desire to build and dedicate to public use a ballfield on PPS-owned land on the grounds of Pittsburgh Faison K-5 School, parcel 0175-B-00320, at 7430 Tioga Street, in the 13th Ward of the City of Pittsburgh, Pennsylvania (“the Site”); and
WHEREAS, the City will fund, design and manage the construction and thereafter perform certain maintenance tasks on the ballfield after construction; and
WHEREAS, PPS and the City now wish to enter into a License and Maintenance Agreement to define the City’s responsibilities for developing and maintaining the ballfield at the Site in accordance with the Drawings/Plans attached hereto as Exhibit A.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. That the Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, are hereby authorized to enter into an Agreement or Agreements with the Board of Public Education of the School District of Pittsburgh, for the Board of Public Education of the School District of Pittsburgh to grant to the City of Pittsburgh, its successors and assigns, and for the City to receive, the privilege and license to construct, maintain and use at the City’s own cost and expense, a ball playing field, to be located on the grounds of Pittsburgh Faison K - 5 School, parcel 0175-B-00320, at 7430 Tioga Street, in the 13th Ward of the City of Pittsburgh, Pennsylvania.
