Resolution authorizing the Mayor and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh, to enter into an agreement with Pittsburgh Downtown Partnership to provide a license for a jointly-sponsored Street mural and Patio area at Strawberry Way.

WHEREAS, the City of Pittsburgh has an interest in maintaining a vibrant downtown street life and therefore, has agreed to co-present artwork with the Pittsburgh Downtown Partnership; and
WHEREAS, the City of Pittsburgh owns the right of way on Strawberry Way and has agreed to permit the Pittsburgh Downtown Partnership to establish and maintain a street mural painting on the surface of the road, and patio areas including tables, chairs, and plants extending from the intersection of Strawberry Way and Grant Street to the intersection of Strawberry Way and Smithfield Street (the “Site”); and
WHEREAS, Pittsburgh Downtown Partnership desires to provide an opportunity for outdoor enjoyment with tables, chairs, and plantings, and paint the street surface at the Site and the CITY has agreed to permit the Pittsburgh Downtown Partnership to do so at no cost to the CITY (“the jointly-sponsored Project”); and
WHEREAS, Pittsburgh Downtown Partnership has agreed to maintain the jointly-sponsored Project and Site for as long as the jointly-sponsored Project and Site are permitted to exist; and
WHEREAS, the parties now desire to set forth the responsibilities for the jointly-sponsored Project;
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh, are hereby authorized to enter into an agreement with Pittsburgh Downtown Partnership to provide a license for a jointly-sponsored Street mural and Patio area at Strawberry Way.
The license area is further depicted on the drawings attached hereto as Exhibit A.
