WHEREAS, CITY proposes to rehabilitate the existing bridge structure carrying South Negley Avenue over RAILWAY's tracks and Port Authority of Allegheny County East Busway in the City of Pittsburgh, Allegheny County, hereinafter referred to as the "Project"; and,

WHEREAS, the Pennsylvania Public Utility Commission (P.U.C.) has exclusive jurisdiction over all rail-highway crossings in the Commonwealth of Pennsylvania and this Project is subject to any existing and future P.U.C. Orders which may set forth cost allocations, work to be performed, and/or maintenance responsibilities; and,

WHEREAS, the tracks of the RAILWAY are located below the grade of the highway at approximately RAILWAY milepost PT-349.90; and

WHEREAS, the Project is eligible for financing with Federal Highway funds, under Federal Project Number X111-831; and,

WHEREAS, a future agreement will be executed, also based on actual costs, for Construction Phase Services; and,

WHEREAS, this agreement covers preliminary engineering services performed starting April 7th, 2020.


Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. The Mayor and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh, are hereby authorized to enter into a Reimbursement Agreement with the Norfolk Southern Railway Company for costs associated with the Preliminary Engineering phase of the South Negley Avenue Bridge Project; providing for the payment of the costs thereof, not to exceed Twenty Five Thousand Six Hundred and Twenty One Dollars ($25,621.00) to be paid from the following account:
