Title

Resolution providing for ratification and extension by the Council of the City of Pittsburgh of a Declaration of Disaster Emergency for ninety (90) additional days thereby making the Declaration effective until May 2nd, 2022 in response to the collapse of the Fern Hollow Bridge; and further authorizing the Mayor and the Mayor’s designated directors, including but not limited to the Director of the Department of Mobility and Infrastructure, to enter into an intergovernmental cooperation agreement or agreements with the Commonwealth of Pennsylvania and its designated agencies including but not limited to the Pennsylvania Department of Transportation and the Pennsylvania Emergency Management Agency for delegation of certain municipal responsibilities and for receipt of aid in response to the collapse of the Fern Hollow Bridge.

 

Body

WHEREAS, the Mayor of the City of Pittsburgh issued a Declaration of Emergency (“Declaration”) in response to the collapse of the Fern Hollow Bridge on January 30th 2022; and

 

WHEREAS, the Mayor of the City Pittsburgh believes that the Declaration of Emergency should be extended for a period not-to-exceed ninety (90) days from the date of potential expiration, subject to further renewal of the Council of the City of Pittsburgh at such time, in order to provide the City of Pittsburgh with the appropriate means to address the existing disaster emergency created by the collapse of the Fern Hollow Bridge; and

 

WHEREAS, as a result, the Council of the City of Pittsburgh wishes to renew the Mayor’s Declaration of Emergency for a period not-to-exceed ninety (90) days; and

 

WHEREAS, pursuant to 53 Pa. C.S. § 2301, et al, the City of Pittsburgh is empowered to enter into intergovernmental cooperation agreements with other governmental entities for purposes including but not limited to cooperation in the exercise of governmental functions, powers or responsibilities and delegation thereof to another governmental unit; and

 

WHEREAS, the City of Pittsburgh seeks to enter into an intergovernmental cooperation agreement with the Commonwealth of Pennsylvania and/or its designated agencies for purposes of cooperation in the exercise of government functions, powers, or responsibilities; the delegation of municipal functions, powers, or responsibilities; the receipt of aid; and all other coordination activities necessitated in response to the collapse of the Fern Hollow Bridge.

 

THEREFORE, be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Declaration of Emergency, issued by the Mayor of City of Pittsburgh on January 30, 2022, attached hereto and incorporated herein as Exhibit A, is hereby extended and renewed by the Council of the City of Pittsburgh for a period of ninety (90) days from February 1st, 2022 to May 2nd, 2022 unless terminated earlier, in accordance with all applicable law including City of Pittsburgh Code §113.03 and the Pennsylvania Emergency Management Services Code at 35 Pa. C.S. § 7501.

 

Section 2.                     The Mayor and the Mayor’s designated directors, including but not limited to the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh, are authorized to enter into an intergovernmental cooperation agreement or agreements, pursuant to 53 Pa. C.S. § 2301, et al;  with the Commonwealth of Pennsylvania and/or its designated agencies, including but not limited to the Pennsylvania Department of Transportation and the Pennsylvania Emergency Management Agency, in order to effectively and cooperatively respond to the collapse of the Fern Hollow Bridge.

 

Section 3. The aforementioned intergovernmental cooperation agreement or agreements shall be for a term not-to-exceed one year, subject to mutual renewal at such time; and will address any or all coordination activities necessary in response to the Fern Hollow Bridge collapse including but not limited to 1. cooperation in the exercise of any pertinent government functions, powers, or responsibilities; 2. the delegation of relevant municipal functions, powers or responsibilities to the Commonwealth and/or its designated agencies; and 3. the receipt or furnishing of aid.
