Resolution amending Resolution 470 of 2019, that originally authorized the Mayor and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh, to enter into a Cooperation Agreement with the Port Authority of Allegheny County, Allegheny County, and the Urban Redevelopment Authority concerning the Bus Rapid Transit Project; to now through an amendment to the aforementioned Cooperation Agreement authorize appropriation of an amount not to exceed twelve million eight hundred thousand dollars ($12,800,000) for use in the Bus Rapid Transit Project and to authorize certain property transfers, easements, vacations, dedications, and right-of-way encroachments with the Port Authority of Allegheny County necessary for completion of the Bus Rapid Transit Project.

WHEREAS, the City of Pittsburgh (“City”), Port Authority of Allegheny County (“Port Authority”), Allegheny County (“County”), and the Urban Redevelopment Authority (“URA”) (collectively the “Parties”); have been engaged in the planning and design of a proposed bus rapid transit link between the central business district of the City of Pittsburgh and Oakland and other East End neighborhoods (“Bus Rapid Transit Project” or “BRT Project”); and
WHEREAS, the BRT Project is in the public interest and will be beneficial and advantageous to the City, County, URA and Port Authority in that it will facilitate the expeditious and effective movement of transit patrons by reducing travel times and improving the quality and reliability of service for people using mass transit, materially contribute to the well-being, progress and development of the City and County, and reduce traffic on City streets; and
WHEREAS, the BRT Project is also intended to stimulate neighborhood revitalization along the BRT Project corridor, as well as incorporate necessary transit and infrastructure improvements between the Central Business District and Oakland and other East End neighborhoods; and
WHEREAS, the City, as authorized by Resolution 470 of 2019, entered into a Cooperation Agreement with the other Parties to facilitate cooperation toward completion of the BRT Project including for BRT Project’s funding, final design, land use planning, construction, operation, and maintenance; and
WHEREAS, the BRT Project has advanced to where the City now wishes to appropriate its contribution of an amount not to exceed twelve million eight hundred thousand dollars ($12,800,000) toward completion of the BRT Project; and
WHEREAS, the City shall receive annual funding from Port Authority for a period of at least three years amounting to Ninety-Two Thousand Five-Hundred Dollars ($92,500) in 2022, Ninety-Five Thousand Dollars ($95,000) in 2023 and Ninety-Seven Thousand Five-Hundred Dollars ($97,500) in 2024 in order to support City’s BRT Project staffing; and
WHEREAS, the Port Authority is holding and managing the contract for construction of the BRT Project which will take place in significant areas of City controlled right-of-way and City owned property; and
WHEREAS, the successful completion of the BRT Project requires certain property and easements to be exchanged between Port Authority and City as well as the City’s acceptance and granting of certain street dedications and encroachments from and to Port Authority; and
WHEREAS, the Parties now wish to enter into an amendment to the aforementioned BRT Cooperation Agreement in order to, among other matters, authorize City’s actions on funding and property transfers.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1 of Resolution 470 of 2019 shall be amended as follows:
Section 1. The Mayor and Director of the Department of Mobility and Infrastructure, on behalf of the City, are now authorized to enter into a Cooperation Agreement with the Port Authority, County, and URA, in order to establish certain responsibilities of and facilitate completion of the BRT Project and to include a City contribution toward the BRT Project at an amount not to exceed Twelve Million Eight Hundred Thousand Dollars ($12,800,000) [Ninety Thousand Dollars ($90,000.00)], chargeable and payable from the following accounts:

Section 2 of Resolution 470 of 2019 shall be amended as follows:
Section 2. The following funding received by the City under the aforementioned Cooperation Agreement will be deposited into the following respective accounts and is authorized for appropriation from the same, subject to receipt, for BRT Project staffing to be acquired through expansion of City personnel or through new Agreements or Contracts authorized to be entered into by the Mayor and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh, or through utilization or existing Agreements or Contracts including City employment contracts:

The following Section are hereby added to Resolution 470 of 2019:
Section 3. The Mayor and the Director of the Department of Finance and the Director of the Department of Public Works are hereby authorized to execute documents with Port Authority as necessary to convey and grant rights-of-entry and/or temporary construction easements over City parcels listed in the schedule attached as Exhibit A, in order to advance the BRT Project.
Section 4. The Mayor and the Director of the Department of Finance and the Director of the Department of Public Works, and/or the Director of the Department of Mobility and Infrastructure are hereby authorized to execute documents as necessary with Port Authority to convey and grant rights-of-entry and/or easements over City parcels and grant encroachments as necessary over City right-of-way listed in the schedule attached as Exhibit B and further depicted for illustrative purposes in the map attached as Exhibit E, in order to facilitate the creation of a comfort station along Mellon Terra[n]ce in furtherance of the BRT Project.
Section 5. The Mayor and the Director of the Department of Finance and the Director of the Department of Public Works, and/or the Director of the Department of Mobility and Infrastructure are hereby authorized to execute documents as necessary with Port Authority to convey and grant rights-of-entry and/or easements over City parcels and grant encroachments as necessary over City right-of-way listed in order to provide Port Authority with access to maintain BRT Stations in furtherance of the BRT Project.
Section 6. The Mayor and the Director of the Department of Finance and the Director of the Department of Public Works, and/or the Director of the Department of Mobility and Infrastructure are hereby authorized to execute documents as necessary with Port Authority for conveyance and recording of certain parcels and easements as listed in the schedule attached as Exhibit C and further depicted for illustrative purposes in the map attached as Exhibit F, in order to provide for a realignment of Kirkpatrick Street in furtherance of the BRT Project.
Section 7. The Mayor and the Director of the Department of Finance and the Director of the Department of Mobility and Infrastructure and are hereby authorized to execute documents as necessary with Port Authority for dedication of certain parcels to public right-of-way, subject to the policies of the Department of Mobility and Infrastructure for such dedications, as listed in the schedule attached as Exhibit D and further depicted for illustrative purposes in the map attached as Exhibit G, in furtherance of the BRT Project.
